AMENDMENT TO HOUSE BILL 4090

2    AMENDMENT NO. ______. Amend House Bill 4090 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Criminal Code of 2012 is amended by
5changing Section 17-8.3 as follows:
 
6    (720 ILCS 5/17-8.3)   (was 720 ILCS 5/17-22)
7    Sec. 17-8.3. False information on an application for
8employment with certain public or private agencies; use of
9false academic degree.
10    (a) It is unlawful for an applicant for employment with a
11public or private agency that provides State funded services to
12persons with mental illness or developmental disabilities to
13knowingly furnish false information regarding professional
14certification, licensing, criminal background, or employment
15history for the 5 years immediately preceding the date of
16application on an application for employment with the agency if

1the position of employment requires or provides opportunity for
2contact with persons with mental illness or developmental
3disabilities.
4    (b) It is unlawful for a person to knowingly use a false
5academic degree for the purpose of obtaining employment,
6obtaining or admission to an institution of higher learning,
7obtaining or admission to an advanced degree program at an
8institution of higher learning, or for the purpose of obtaining
9a promotion or higher compensation in employment.
10    (c) Sentence. A violation of this Section is a Class A
11misdemeanor.
