SYNOPSIS AS INTRODUCED:
 
20 ILCS 2310/2310-685 new

    Amends the Department of Public Health Powers and Duties Law of the Civil Administrative Code of Illinois. Provides that the Department shall develop and implement a public education program to educate the public about the provisions of the Illinois Controlled Substances Act granting limited immunity from prosecution for drug overdose victims or persons seeking help for drug overdose victims if the only evidence for the possession charge was obtained as a result of the person seeking or obtaining emergency medical assistance.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Department of Public Health Powers and
5Duties Law of the Civil Administrative Code of Illinois is
6amended by adding Section 2310-685 as follows:
 
7    (20 ILCS 2310/2310-685 new)
8    Sec. 2310-685. Immunity from prosecution; drugs; public
9education program. The Department shall develop and implement a
10public education program to educate the public about the
11provisions set forth in Section 414 of the Illinois Controlled
12Substances Act, also referred to as the Good Samaritan Overdose
13Law, granting limited immunity from prosecution for drug
14overdose victims or persons seeking help for drug overdose
15victims if the only evidence for the possession charge was
16obtained as a result of the person seeking or obtaining
17emergency medical assistance.
