1    AN ACT concerning public employee benefits.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Pension Code is amended by changing
5Sections 5-167.5, 6-164.2, 8-164.1, 8-164.2, 11-160.1, and
611-160.2 as follows:
 
7    (40 ILCS 5/5-167.5)  (from Ch. 108 1/2, par. 5-167.5)
8    Sec. 5-167.5. Payments to city.
9    (a) For the purposes of this Section, "city annuitant"
10means a person receiving an age and service annuity, a widow's
11annuity, a child's annuity, or a minimum annuity under this
12Article as a direct result of previous employment by the City
13of Chicago ("the city").
14    (b) The board shall pay to the city, on behalf of the
15board's city annuitants who participate in any of the city's
16health care plans, the following amounts:
17        (1) From July 1, 2003 through June 30, 2008, $85 per
18    month for each such annuitant who is not eligible to
19    receive Medicare benefits and $55 per month for each such
20    annuitant who is eligible to receive Medicare benefits.
21        (2) Beginning From July 1, 2008 and until such time as
22    the city no longer provides a health care plan for such
23    annuitants or December 31, 2016, whichever comes first

1    through June 30, 2013, $95 per month for each such
2    annuitant who is not eligible to receive Medicare benefits
3    and $65 per month for each such annuitant who is eligible
4    to receive Medicare benefits.
5    The payments described in this subsection shall be paid
6from the tax levy authorized under Section 5-168; such amounts
7shall be credited to the reserve for group hospital care and
8group medical and surgical plan benefits, and all payments to
9the city required under this subsection shall be charged
10against it.
11    (c) The city health care plans referred to in this Section
12and the board's payments to the city under this Section are not
13and shall not be construed to be pension or retirement benefits
14for the purposes of Section 5 of Article XIII of the Illinois
15Constitution of 1970.

11retiree health plan, the board is authorized to pay to the
12Board of Education, on behalf of each eligible annuitant who
13chooses to participate in the Board of Education's retiree
14health benefit plan, the following amounts:
15        (1) From July 1, 2003 through June 30, 2008, $85 per
16    month for each such annuitant who is not eligible to
17    receive Medicare benefits and $55 per month for each such
18    annuitant who is eligible to receive Medicare benefits.
19        (2) Beginning From July 1, 2008 and until such time as
20    the city no longer provides a health care plan for such
21    annuitants or December 31, 2016, whichever comes first
22    through June 30, 2013, $95 per month for each such
23    annuitant who is not eligible to receive Medicare benefits
24    and $65 per month for each such annuitant who is eligible
25    to receive Medicare benefits.

1    The payments described in this subsection shall be paid
2from the tax levy authorized under Section 8-173; such amounts
3shall be credited to the reserve for group hospital care and
4group medical and surgical plan benefits, and all payments to
5the Board of Education under this subsection shall be charged
6against it.
7    (b) The Board of Education health benefit plan referred to
8in this Section and the board's payments to the Board of
9Education under this Section are not and shall not be construed
10to be pension or retirement benefits for the purposes of
11Section 5 of Article XIII of the Illinois Constitution of 1970.

17and shall not be construed to be pension or retirement benefits
18for the purposes of Section 5 of Article XIII of the Illinois
19Constitution of 1970.

11    through June 30, 2013, $95 per month for each such
12    annuitant who is not eligible to receive Medicare benefits
13    and $65 per month for each such annuitant who is eligible
14    to receive Medicare benefits.
15    The payments described in this subsection shall be paid
16from the tax levy authorized under Section 11-169; such amounts
17shall be credited to the reserve for group hospital care and
18group medical and surgical plan benefits, and all payments to
19the Board of Education under this subsection shall be charged
20against it.
21    (b) The Board of Education health benefit plan referred to
22in this Section and the board's payments to the Board of
23Education under this Section are not and shall not be construed
24to be pension or retirement benefits for the purposes of
25Section 5 of Article XIII of the Illinois Constitution of 1970.

1    Section 99. Effective date. This Act takes effect upon
2becoming law.
