2 | AMENDMENT NO. ______. Amend Senate Bill 2015 by replacing | ||||||
3 | everything after the enacting clause with the following:
| ||||||
4 | "Section 5. The Illinois Vehicle Code is amended by | ||||||
5 | changing Sections 1-214 and 11-601 as follows:
| ||||||
6 | (625 ILCS 5/1-214) (from Ch. 95 1/2, par. 1-214)
| ||||||
7 | Sec. 1-214. Urban district.
| ||||||
8 | The territory contiguous to and including any street , | ||||||
9 | excluding interstate highways and tollways, which is built up
| ||||||
10 | with structures devoted to business, industry or dwelling | ||||||
11 | houses situated
at intervals of less than 100 feet for a | ||||||
12 | distance of a quarter of a mile or
more.

15 | Sec. 11-601. General speed restrictions.

1 | (a) No vehicle may be driven upon any highway of this State | ||||||
2 | at a speed
which is greater than is reasonable and proper with | ||||||
3 | regard to traffic
conditions and the use of the highway, or | ||||||
4 | endangers the safety of any
person or property. The fact that | ||||||
5 | the speed of a vehicle does not exceed
the applicable maximum | ||||||
6 | speed limit does not relieve the driver from the
duty to | ||||||
7 | decrease speed when approaching and crossing an intersection,
| ||||||
8 | approaching and going around a curve, when approaching a hill | ||||||
9 | crest, when
traveling upon any narrow or winding roadway, or | ||||||
10 | when special hazard exists
with respect to pedestrians or other | ||||||
11 | traffic or by reason of weather or
highway conditions. Speed | ||||||
12 | must be decreased as may be necessary to avoid
colliding with | ||||||
13 | any person or vehicle on or entering the highway in
compliance | ||||||
14 | with legal requirements and the duty of all persons to use due
| ||||||
15 | care.
| ||||||
16 | (b) No person may drive a vehicle upon any highway of this | ||||||
17 | State at a
speed which is greater than the applicable statutory | ||||||
18 | maximum speed limit
established by paragraphs (c), (d), (e), | ||||||
19 | (f) or (g) of this Section, by
Section 11-605 or by a | ||||||
20 | regulation or ordinance made under this Chapter.
| ||||||
21 | (c) Unless some other speed restriction is established | ||||||
22 | under this
Chapter, the maximum speed limit in an urban | ||||||
23 | district for all vehicles is:
| ||||||
24 | 1. 30 miles per hour; and
| ||||||
25 | 2. 15 miles per hour in an alley.
| ||||||
26 | (d) Unless some other speed restriction is established |
| |||||||
| |||||||
1 | under this Chapter,
the maximum speed limit outside an urban | ||||||
2 | district for any vehicle is (1) 65 miles per hour (i) for
all | ||||||
3 | highways under the jurisdiction of the Illinois State Toll
| ||||||
4 | Highway Authority, unless some other speed limit is designated, | ||||||
5 | and (ii) for all or part of highways that are designated by
the | ||||||
6 | Department, have at least 4 lanes of traffic, and have a | ||||||
7 | separation between
the roadways moving in opposite directions | ||||||
8 | and (2) 55 miles per hour for all
other highways, roads, and | ||||||
9 | streets.
| ||||||
10 | (d-1) Unless some other speed restriction is established | ||||||
11 | under this Chapter,
the maximum speed limit outside an urban | ||||||
12 | district for any vehicle is (1) 70 miles per hour on any | ||||||
13 | interstate highway as defined by Section 1-133.1 of this Code | ||||||
14 | and all highways under the jurisdiction of the Illinois State | ||||||
15 | Toll Highway Authority ; (2) 65 miles per hour for all or part | ||||||
16 | of highways that are designated by the Department, have at | ||||||
17 | least 4 lanes of traffic, and have a separation between the | ||||||
18 | roadways moving in opposite directions; and (3) 55 miles per | ||||||
19 | hour for all other highways, roads, and streets. The counties | ||||||
20 | of Cook, DuPage, Kane, Lake, Madison, McHenry, St. Clair, and | ||||||
21 | Will may adopt ordinances setting a maximum speed limit on | ||||||
22 | highways, roads, and streets that is lower than the limits | ||||||
23 | established by this Section. | ||||||
24 | (e) In the counties of Cook, DuPage, Kane, Lake, McHenry, | ||||||
25 | and Will, unless some lesser speed restriction is established | ||||||
26 | under
this
Chapter, the maximum speed limit outside an urban |

| |||||||
1 | district for a second
division vehicle designed or used for the | ||||||
2 | carrying of a gross weight of
8,001 pounds or more (including | ||||||
3 | the weight of the vehicle and
maximum load) is
55 miles per | ||||||
4 | hour.

5 | (e-1) (Blank). | ||||||
6 | (f) Unless some other speed restriction is established | ||||||
7 | under this Chapter,
the maximum speed limit outside an urban | ||||||
8 | district for a bus is:
| ||||||
9 | 1. 65 miles per hour upon any highway which has at | ||||||
10 | least 4 lanes of
traffic
and of which the roadways for | ||||||
11 | traffic moving in opposite directions are
separated by a | ||||||
12 | strip of ground which is not surfaced or suitable for | ||||||
13 | vehicular
traffic, except that the maximum speed limit for | ||||||
14 | a bus on all highways,
roads, or streets not under the | ||||||
15 | jurisdiction of the Department or the Illinois
State Toll | ||||||
16 | Highway Authority
is 55 miles per hour;
| ||||||
17 | 1.5. 70 miles per hour upon any interstate highway as | ||||||
18 | defined by Section 1-133.1 of this Code outside the | ||||||
19 | counties of Cook, DuPage, Kane, Lake, McHenry, and Will; | ||||||
20 | and
| ||||||
21 | 2. 55 miles per hour on any other highway.
