licensed under the Medical Practice Act |

4 | | Special activities in physical education shall be provided |
5 | | for pupils
whose physical or emotional condition, as determined |
6 | | by a person licensed
under the Medical Practice Act of 1987, |
7 | | prevents their participation in the
courses provided for normal |
8 | | children.
|
9 | | (b) A school board is authorized to excuse pupils enrolled
|
10 | | in grades 11 and 12 from engaging in physical education courses |
11 | | if those
pupils request to be excused for any of the following |
12 | | reasons: (1) for
ongoing participation in an interscholastic
|
13 | | athletic program; (2) to enroll in academic classes which are |
14 | | required for
admission to an institution of higher learning, |
15 | | provided that failure to
take such classes will result in the |
16 | | pupil being denied admission to the
institution of his or her |
17 | | choice; or (3) to enroll in academic classes
which are required |
18 | | for graduation from high school, provided that failure to
take |
19 | | such classes will result in the pupil being unable to graduate. |
20 | | A school
board may also excuse pupils in grades 9 through 12 |
21 | | enrolled in a marching band program for credit from engaging in |
22 | | physical education courses if those pupils
request to be |
23 | | excused for ongoing participation in such marching band

24 | | program. A school board may excuse pupils in grades 9 through |
25 | | 12 enrolled in a show choir program, for credit and taught by a |
26 | | licensed teacher, from engaging in physical education courses |

1 | | if those pupils request to be excused for ongoing participation |
2 | | in the show choir program, if those pupils are excused only one |
3 | | semester per school term, and if the show choir program |
4 | | emphasizes dance-type movement with singing. In addition, a |
5 | | pupil
in any of grades 3 through 12 who is eligible for special |
6 | | education may be excused if the pupil's parent or guardian |
7 | | agrees that the pupil
must utilize the time set aside for |
8 | | physical education to receive special education support and |
9 | | services or, if there is no agreement, the individualized |
10 | | education program team for the pupil determines that the pupil |
11 | | must utilize the time set aside for physical education to |
12 | | receive special education support and services, which |
13 | | agreement or determination must be made a part of the |
14 | | individualized education program. However, a pupil requiring |
15 | | adapted physical education must receive that service in |
16 | | accordance with the individualized education program developed |
17 | | for the pupil. A school board may also excuse pupils in grades |
18 | | 9 through 12 enrolled
in a Reserve Officer's Training Corps |
19 | | (ROTC) program sponsored by the school
district from engaging |
20 | | in physical education courses.
School boards which choose to |
21 | | exercise this authority shall establish a policy
to excuse |
22 | | pupils on an individual basis.

23 | | (c) The provisions of this Section are subject to the |
24 | | provisions of
Section 27-22.05.
