1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Fiscal Note Act is amended by changing
5Section 2 as follows:
 
6    (25 ILCS 50/2)  (from Ch. 63, par. 42.32)
7    Sec. 2. The sponsor of each bill, referred to in Section 1,
8shall present a copy of the bill, with his request for a fiscal
9note, to the board, commission, department, agency, or other
10entity of the State which is to receive or expend the
11appropriation proposed or which is responsible for collection
12of the revenue proposed to be increased or decreased, or to be
13levied or provided for. The sponsor of a bill that amends the
14Mental Health and Developmental Disabilities Code or the
15Developmental Disability and Mental Disability Services Act
16shall present a copy of the bill, with his or her request for a
17fiscal note, to the Department of Human Services. The fiscal
18note shall be prepared by such board, commission, department,
19agency, or other entity and furnished to the sponsor of the
20bill within 5 calendar days thereafter; except that whenever,
21because of the complexity of the measure, additional time is
22required for preparation of the fiscal note, the board,
23commission, department, agency, or other entity may so inform

1the sponsor of the bill and he may approve an extension of the
2time within which the note is to be furnished, not to extend,
3however, beyond June 15, following the date of the request.
4Whenever any measure for which a fiscal note is required
5affects more than one State board, commission, department,
6agency, or other entity, the board, commission, department,
7agency, or other entity most affected by its provisions
8according to the sponsor shall be responsible for preparation
9of the fiscal note. Whenever any measure for which a fiscal
10note is required does not affect a specific board, commission,
11department, agency or other such entity, or does not amend the
12Mental Health and Developmental Disabilities Code or the
13Developmental Disability and Mental Disability Services Act,
14the sponsor of the measure shall be responsible for preparation
15of the fiscal note.
16    Whenever any measure has the effect of rebalancing long
17term care services from residential settings to community or
18home-based services or from home and community-based services
19to residential services, the affected agencies shall work in
20concert to extrapolate the estimated costs or savings of such
21an initiative. The ensuing note shall include all financial
22aspects of the measure including federal resources and the
23impact of any provider assessments in place to ascertain the
24true costs or savings of the measure.
25    In the case of bills having a potential fiscal impact on
26units of local government, the fiscal note shall be prepared by

1the Department of Commerce and Economic Opportunity. In the
2case of bills having a potential fiscal impact on school
3districts, the fiscal note shall be prepared by the State
4Superintendent of Education. In the case of bills having a
5potential fiscal impact on community college districts, the
6fiscal note shall be prepared by the Illinois Community College
7Board.

9    Section 99. Effective date. This Act takes effect upon
10becoming law.
