SYNOPSIS AS INTRODUCED:
 
20 ILCS 3960/5.3

    Amends the Illinois Health Facilities Planning Act. Provides that the annual report of capital expenditures submitted to the Health Facilities and Services Review Board by certain health care facilities shall include (i) whether the health care facility administered an affirmative action program for minority-owned, women-owned, veteran-owned, and small business enterprises and (ii) the percentage of the annual capital expenditure that was actually spent on minority-owned, women-owned, veteran-owned, and small business enterprises, respectively. Provides that the Board shall not consider that information when reviewing an application for a permit or exemption under the Act. Effective immediately.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Health Facilities Planning Act is
5amended by changing Section 5.3 as follows:
 
6    (20 ILCS 3960/5.3)
7    (Section scheduled to be repealed on December 31, 2019)
8    Sec. 5.3. Annual report of capital expenditures. In
9addition to the State Board's authority to require reports, the
10State Board shall require each health care facility to submit
11an annual report of all capital expenditures in excess of
12$200,000 (which shall be annually adjusted to reflect the
13increase in construction costs due to inflation) made by the
14health care facility during the most recent year. This annual
15report shall consist of a brief description of the capital
16expenditure, the amount and method of financing the capital
17expenditure, the certificate of need project number if the
18project was reviewed, and the total amount of capital
19expenditures obligated for the year. This annual report shall
20also include (i) whether the health care facility administered
21an affirmative action program for minority-owned, women-owned,
22veteran-owned, and small business enterprises and (ii) the
23percentage of the annual capital expenditure that was actually

1spent on minority-owned, women-owned, veteran-owned, and small
2business enterprises, respectively; however, the Board shall
3not consider the information provided in items (i) and (ii)
4when reviewing an application for a permit or exemption under
5this Act. Data collected from health care facilities pursuant
6to this Section shall not duplicate or overlap other data
7collected by the Department and must be collected as part of
8the Department's Annual Questionnaires or supplements for
9health care facilities that report these data.

11    Section 99. Effective date. This Act takes effect upon
12becoming law.
