AMENDMENT TO SENATE BILL 2644

2    AMENDMENT NO. ______. Amend Senate Bill 2644, AS AMENDED,
3with reference to page and line numbers of House Amendment No.
42, as follows:
 
5on page 1, line 5, by replacing "Section 6-11" with "Sections
66-11 and 6-15"; and
 
7on page 41, immediately below line 13, by inserting the
8following:
9    "(uu) Notwithstanding any provision of this Section to the
10contrary, nothing in this Section shall prohibit the issuance
11or renewal of a license authorizing the sale of alcoholic
12liquor at premises located within a municipality with a
13population in excess of 1,000,000 inhabitants and within 100
14feet of a church if:
15        (1) the sale of alcoholic liquor is not the principal
16    business carried on by the licensee at the premises;

1        (2) the sale of alcoholic liquor is incidental to the
2    operation of a grocery store;
3        (3) the premises are located in a building that is
4    approximately 68,000 square feet with 157 parking spaces on
5    property that was previously vacant land;
6        (4) the main entrance to the church faces west and is
7    at least 500 feet from the entrance of the premises, which
8    faces north;
9        (5) the church and the premises are separated by an
10    alley;
11        (6) the applicant is the owner of 9 similar grocery
12    stores in the City of Chicago and the surrounding area and
13    has been in business for more than 40 years;
14        (7) the principal religious leader of the church has
15    indicated his or her support for the issuance of the
16    license in writing; and
17        (8) the alderman of the ward in which the premises are
18    located has expressed, in writing, his or her support for
19    the issuance of the license.
20    (vv) Notwithstanding any provision of this Section to the
21contrary, nothing in this Section shall prohibit the issuance
22or renewal of a license authorizing the sale of alcoholic
23liquor at premises located within a municipality with a
24population in excess of 1,000,000 inhabitants and within 100
25feet of a church if:
26        (1) the sale of alcoholic liquor is the principal

1    business carried on by the licensee at the premises;
2        (2) the sale of alcoholic liquor is primary to the sale
3    of food;
4        (3) the premises are located south of the church and on
5    perpendicular streets and are separated by a driveway;
6        (4) the primary entrance of the premises is at least
7    100 feet from the primary entrance of the church;
8        (5) the shortest distance between any part of the
9    premises and any part of the church is at least 15 feet;
10        (6) the premises are less than 100 feet from the church
11    center, but greater than 100 feet from the area within the
12    building where church services are held;
13        (7) the premises are 25,830 square feet and sit on a
14    lot that is 0.48 acres;
15        (8) the premises were once designated as a Korean
16    American Presbyterian Church and were once used as a
17    Masonic Temple;
18        (9) the premises were built in 1910;
19        (10) the alderman of the ward in which the premises are
20    located has expressed, in writing, his or her support for
21    the issuance of the license; and
22        (11) the principal religious leader of the church has
23    delivered a written statement that he or she does not
24    object to the issuance of a license under this subsection
25    (vv).
26    For the purposes of this subsection (vv), "premises" means

1a place of business together with a privately owned outdoor
2location that is adjacent to the place of business.
3    (ww) Notwithstanding any provision of this Section to the
4contrary, nothing in this Section shall prohibit the issuance
5or renewal of a license authorizing the sale of alcoholic
6liquor at premises located within a municipality with a
7population in excess of 1,000,000 inhabitants and within 100
8feet of a school if:
9        (1) the school is located within Sub Area III of City
10    of Chicago Residential-Business Planned Development Number
11    523, as amended; and
12        (2) the premises are located within Sub Area I, Sub
13    Area II, or Sub Area IV of City of Chicago
14    Residential-Business Planned Development Number 523, as
15    amended."; and
 
16on page 41, immediately below line 18, by inserting the
17following:
 
18    "(235 ILCS 5/6-15)  (from Ch. 43, par. 130)
19    Sec. 6-15. No alcoholic liquors shall be sold or delivered
20in any building belonging to or under the control of the State
21or any political subdivision thereof except as provided in this
22Act. The corporate authorities of any city, village,
23incorporated town, township, or county may provide by
24ordinance, however, that alcoholic liquor may be sold or

1delivered in any specifically designated building belonging to
2or under the control of the municipality, township, or county,
3or in any building located on land under the control of the
4municipality, township, or county; provided that such township
5or county complies with all applicable local ordinances in any
6incorporated area of the township or county. Alcoholic liquor
7may be delivered to and sold under the authority of a special
8use permit on any property owned by a conservation district
9organized under the Conservation District Act, provided that
10(i) the alcoholic liquor is sold only at an event authorized by
11the governing board of the conservation district, (ii) the
12issuance of the special use permit is authorized by the local
13liquor control commissioner of the territory in which the
14property is located, and (iii) the special use permit
15authorizes the sale of alcoholic liquor for one day or less.
16Alcoholic liquors may be delivered to and sold at any airport
17belonging to or under the control of a municipality of more
18than 25,000 inhabitants, or in any building or on any golf
19course owned by a park district organized under the Park
20District Code, subject to the approval of the governing board
21of the district, or in any building or on any golf course owned
22by a forest preserve district organized under the Downstate
23Forest Preserve District Act, subject to the approval of the
24governing board of the district, or on the grounds within 500
25feet of any building owned by a forest preserve district
26organized under the Downstate Forest Preserve District Act

1during times when food is dispensed for consumption within 500
2feet of the building from which the food is dispensed, subject
3to the approval of the governing board of the district, or in a
4building owned by a Local Mass Transit District organized under
5the Local Mass Transit District Act, subject to the approval of
6the governing Board of the District, or in Bicentennial Park,
7or on the premises of the City of Mendota Lake Park located
8adjacent to Route 51 in Mendota, Illinois, or on the premises
9of Camden Park in Milan, Illinois, or in the community center
10owned by the City of Loves Park that is located at 1000 River
11Park Drive in Loves Park, Illinois, or, in connection with the
12operation of an established food serving facility during times
13when food is dispensed for consumption on the premises, and at
14the following aquarium and museums located in public parks: Art
15Institute of Chicago, Chicago Academy of Sciences, Chicago
16Historical Society, Field Museum of Natural History, Museum of
17Science and Industry, DuSable Museum of African American
18History, John G. Shedd Aquarium and Adler Planetarium, or at
19Lakeview Museum of Arts and Sciences in Peoria, or in
20connection with the operation of the facilities of the Chicago
21Zoological Society or the Chicago Horticultural Society on land
22owned by the Forest Preserve District of Cook County, or on any
23land used for a golf course or for recreational purposes owned
24by the Forest Preserve District of Cook County, subject to the
25control of the Forest Preserve District Board of Commissioners
26and applicable local law, provided that dram shop liability

1insurance is provided at maximum coverage limits so as to hold
2the District harmless from all financial loss, damage, and
3harm, or in any building located on land owned by the Chicago
4Park District if approved by the Park District Commissioners,
5or on any land used for a golf course or for recreational
6purposes and owned by the Illinois International Port District
7if approved by the District's governing board, or at any
8airport, golf course, faculty center, or facility in which
9conference and convention type activities take place belonging
10to or under control of any State university or public community
11college district, provided that with respect to a facility for
12conference and convention type activities alcoholic liquors
13shall be limited to the use of the convention or conference
14participants or participants in cultural, political or
15educational activities held in such facilities, and provided
16further that the faculty or staff of the State university or a
17public community college district, or members of an
18organization of students, alumni, faculty or staff of the State
19university or a public community college district are active
20participants in the conference or convention, or in Memorial
21Stadium on the campus of the University of Illinois at
22Urbana-Champaign during games in which the Chicago Bears
23professional football team is playing in that stadium during
24the renovation of Soldier Field, not more than one and a half
25hours before the start of the game and not after the end of the
26third quarter of the game, or in the Pavilion Facility on the

1campus of the University of Illinois at Chicago during games in
2which the Chicago Storm professional soccer team is playing in
3that facility, not more than one and a half hours before the
4start of the game and not after the end of the third quarter of
5the game, or in the Pavilion Facility on the campus of the
6University of Illinois at Chicago during games in which the
7WNBA professional women's basketball team is playing in that
8facility, not more than one and a half hours before the start
9of the game and not after the 10-minute mark of the second half
10of the game, or by a catering establishment which has rented
11facilities from a board of trustees of a public community
12college district, or in a restaurant that is operated by a
13commercial tenant in the North Campus Parking Deck building
14that (1) is located at 1201 West University Avenue, Urbana,
15Illinois and (2) is owned by the Board of Trustees of the
16University of Illinois, or, if approved by the District board,
17on land owned by the Metropolitan Sanitary District of Greater
18Chicago and leased to others for a term of at least 20 years.
19Nothing in this Section precludes the sale or delivery of
20alcoholic liquor in the form of original packaged goods in
21premises located at 500 S. Racine in Chicago belonging to the
22University of Illinois and used primarily as a grocery store by
23a commercial tenant during the term of a lease that predates
24the University's acquisition of the premises; but the
25University shall have no power or authority to renew, transfer,
26or extend the lease with terms allowing the sale of alcoholic

1liquor; and the sale of alcoholic liquor shall be subject to
2all local laws and regulations. After the acquisition by
3Winnebago County of the property located at 404 Elm Street in
4Rockford, a commercial tenant who sold alcoholic liquor at
5retail on a portion of the property under a valid license at
6the time of the acquisition may continue to do so for so long
7as the tenant and the County may agree under existing or future
8leases, subject to all local laws and regulations regarding the
9sale of alcoholic liquor. Alcoholic liquors may be delivered to
10and sold at Memorial Hall, located at 211 North Main Street,
11Rockford, under conditions approved by Winnebago County and
12subject to all local laws and regulations regarding the sale of
13alcoholic liquor. Each facility shall provide dram shop
14liability in maximum insurance coverage limits so as to save
15harmless the State, municipality, State university, airport,
16golf course, faculty center, facility in which conference and
17convention type activities take place, park district, Forest
18Preserve District, public community college district,
19aquarium, museum, or sanitary district from all financial loss,
20damage or harm. Alcoholic liquors may be sold at retail in
21buildings of golf courses owned by municipalities or Illinois
22State University in connection with the operation of an
23established food serving facility during times when food is
24dispensed for consumption upon the premises. Alcoholic liquors
25may be delivered to and sold at retail in any building owned by
26a fire protection district organized under the Fire Protection

1District Act, provided that such delivery and sale is approved
2by the board of trustees of the district, and provided further
3that such delivery and sale is limited to fundraising events
4and to a maximum of 6 events per year. However, the limitation
5to fundraising events and to a maximum of 6 events per year
6does not apply to the delivery, sale, or manufacture of
7alcoholic liquors at the building located at 59 Main Street in
8Oswego, Illinois, owned by the Oswego Fire Protection District
9if the alcoholic liquor is sold or dispensed as approved by the
10Oswego Fire Protection District and the property is no longer
11being utilized for fire protection purposes.
12    Alcoholic liquors may be served or sold in buildings under
13the control of the Board of Trustees of the University of
14Illinois for events that the Board may determine are public
15events and not related student activities. The Board of
16Trustees shall issue a written policy within 6 months of the
17effective date of this amendatory Act of the 95th General
18Assembly concerning the types of events that would be eligible
19for an exemption. Thereafter, the Board of Trustees may issue
20revised, updated, new, or amended policies as it deems
21necessary and appropriate. In preparing its written policy, the
22Board of Trustees shall, among other factors it considers
23relevant and important, give consideration to the following:
24(i) whether the event is a student activity or student related
25activity; (ii) whether the physical setting of the event is
26conducive to control of liquor sales and distribution; (iii)

1the ability of the event operator to ensure that the sale or
2serving of alcoholic liquors and the demeanor of the
3participants are in accordance with State law and University
4policies; (iv) regarding the anticipated attendees at the
5event, the relative proportion of individuals under the age of
621 to individuals age 21 or older; (v) the ability of the venue
7operator to prevent the sale or distribution of alcoholic
8liquors to individuals under the age of 21; (vi) whether the
9event prohibits participants from removing alcoholic beverages
10from the venue; and (vii) whether the event prohibits
11participants from providing their own alcoholic liquors to the
12venue. In addition, any policy submitted by the Board of
13Trustees to the Illinois Liquor Control Commission must require
14that any event at which alcoholic liquors are served or sold in
15buildings under the control of the Board of Trustees shall
16require the prior written approval of the Office of the
17Chancellor for the University campus where the event is
18located. The Board of Trustees shall submit its policy, and any
19subsequently revised, updated, new, or amended policies, to the
20Illinois Liquor Control Commission, and any University event,
21or location for an event, exempted under such policies shall
22apply for a license under the applicable Sections of this Act.
23    Alcoholic liquors may be served or sold in buildings under
24the control of the Board of Trustees of Northern Illinois
25University for events that the Board may determine are public
26events and not student-related activities. The Board of

1Trustees shall issue a written policy within 6 months after
2June 28, 2011 (the effective date of Public Act 97-45)
3concerning the types of events that would be eligible for an
4exemption. Thereafter, the Board of Trustees may issue revised,
5updated, new, or amended policies as it deems necessary and
6appropriate. In preparing its written policy, the Board of
7Trustees shall, in addition to other factors it considers
8relevant and important, give consideration to the following:
9(i) whether the event is a student activity or student-related
10activity; (ii) whether the physical setting of the event is
11conducive to control of liquor sales and distribution; (iii)
12the ability of the event operator to ensure that the sale or
13serving of alcoholic liquors and the demeanor of the
14participants are in accordance with State law and University
15policies; (iv) the anticipated attendees at the event and the
16relative proportion of individuals under the age of 21 to
17individuals age 21 or older; (v) the ability of the venue
18operator to prevent the sale or distribution of alcoholic
19liquors to individuals under the age of 21; (vi) whether the
20event prohibits participants from removing alcoholic beverages
21from the venue; and (vii) whether the event prohibits
22participants from providing their own alcoholic liquors to the
23venue.
24    Alcoholic liquors may be served or sold in buildings under
25the control of the Board of Trustees of Chicago State
26University for events that the Board may determine are public

1events and not student-related activities. The Board of
2Trustees shall issue a written policy within 6 months after
3August 2, 2013 (the effective date of Public Act 98-132) this
4amendatory Act of the 98th General Assembly concerning the
5types of events that would be eligible for an exemption.
6Thereafter, the Board of Trustees may issue revised, updated,
7new, or amended policies as it deems necessary and appropriate.
8In preparing its written policy, the Board of Trustees shall,
9in addition to other factors it considers relevant and
10important, give consideration to the following: (i) whether the
11event is a student activity or student-related activity; (ii)
12whether the physical setting of the event is conducive to
13control of liquor sales and distribution; (iii) the ability of
14the event operator to ensure that the sale or serving of
15alcoholic liquors and the demeanor of the participants are in
16accordance with State law and University policies; (iv) the
17anticipated attendees at the event and the relative proportion
18of individuals under the age of 21 to individuals age 21 or
19older; (v) the ability of the venue operator to prevent the
20sale or distribution of alcoholic liquors to individuals under
21the age of 21; (vi) whether the event prohibits participants
22from removing alcoholic beverages from the venue; and (vii)
23whether the event prohibits participants from providing their
24own alcoholic liquors to the venue.
25    Alcoholic liquors may be served or sold in buildings under
26the control of the Board of Trustees of Illinois State

1University for events that the Board may determine are public
2events and not student-related activities. The Board of
3Trustees shall issue a written policy within 6 months after the
4effective date of this amendatory Act of the 97th General
5Assembly concerning the types of events that would be eligible
6for an exemption. Thereafter, the Board of Trustees may issue
7revised, updated, new, or amended policies as it deems
8necessary and appropriate. In preparing its written policy, the
9Board of Trustees shall, in addition to other factors it
10considers relevant and important, give consideration to the
11following: (i) whether the event is a student activity or
12student-related activity; (ii) whether the physical setting of
13the event is conducive to control of liquor sales and
14distribution; (iii) the ability of the event operator to ensure
15that the sale or serving of alcoholic liquors and the demeanor
16of the participants are in accordance with State law and
17University policies; (iv) the anticipated attendees at the
18event and the relative proportion of individuals under the age
19of 21 to individuals age 21 or older; (v) the ability of the
20venue operator to prevent the sale or distribution of alcoholic
21liquors to individuals under the age of 21; (vi) whether the
22event prohibits participants from removing alcoholic beverages
23from the venue; and (vii) whether the event prohibits
24participants from providing their own alcoholic liquors to the
25venue.
26    Alcoholic liquor may be delivered to and sold at retail in

1the Dorchester Senior Business Center owned by the Village of
2Dolton if the alcoholic liquor is sold or dispensed only in
3connection with organized functions for which the planned
4attendance is 20 or more persons, and if the person or facility
5selling or dispensing the alcoholic liquor has provided dram
6shop liability insurance in maximum limits so as to hold
7harmless the Village of Dolton and the State from all financial
8loss, damage and harm.
9    Alcoholic liquors may be delivered to and sold at retail in
10any building used as an Illinois State Armory provided:
11        (i) the Adjutant General's written consent to the
12    issuance of a license to sell alcoholic liquor in such
13    building is filed with the Commission;
14        (ii) the alcoholic liquor is sold or dispensed only in
15    connection with organized functions held on special
16    occasions;
17        (iii) the organized function is one for which the
18    planned attendance is 25 or more persons; and
19        (iv) the facility selling or dispensing the alcoholic
20    liquors has provided dram shop liability insurance in
21    maximum limits so as to save harmless the facility and the
22    State from all financial loss, damage or harm.
23    Alcoholic liquors may be delivered to and sold at retail in
24the Chicago Civic Center, provided that:
25        (i) the written consent of the Public Building
26    Commission which administers the Chicago Civic Center is

1    filed with the Commission;
2        (ii) the alcoholic liquor is sold or dispensed only in
3    connection with organized functions held on special
4    occasions;
5        (iii) the organized function is one for which the
6    planned attendance is 25 or more persons;
7        (iv) the facility selling or dispensing the alcoholic
8    liquors has provided dram shop liability insurance in
9    maximum limits so as to hold harmless the Civic Center, the
10    City of Chicago and the State from all financial loss,
11    damage or harm; and
12        (v) all applicable local ordinances are complied with.
13    Alcoholic liquors may be delivered or sold in any building
14belonging to or under the control of any city, village or
15incorporated town where more than 75% of the physical
16properties of the building is used for commercial or
17recreational purposes, and the building is located upon a pier
18extending into or over the waters of a navigable lake or stream
19or on the shore of a navigable lake or stream. In accordance
20with a license issued under this Act, alcoholic liquor may be
21sold, served, or delivered in buildings and facilities under
22the control of the Department of Natural Resources during
23events or activities lasting no more than 7 continuous days
24upon the written approval of the Director of Natural Resources
25acting as the controlling government authority. The Director of
26Natural Resources may specify conditions on that approval,

1including but not limited to requirements for insurance and
2hours of operation. Notwithstanding any other provision of this
3Act, alcoholic liquor sold by a United States Army Corps of
4Engineers or Department of Natural Resources concessionaire
5who was operating on June 1, 1991 for on-premises consumption
6only is not subject to the provisions of Articles IV and IX.
7Beer and wine may be sold on the premises of the Joliet Park
8District Stadium owned by the Joliet Park District when written
9consent to the issuance of a license to sell beer and wine in
10such premises is filed with the local liquor commissioner by
11the Joliet Park District. Beer and wine may be sold in
12buildings on the grounds of State veterans' homes when written
13consent to the issuance of a license to sell beer and wine in
14such buildings is filed with the Commission by the Department
15of Veterans' Affairs, and the facility shall provide dram shop
16liability in maximum insurance coverage limits so as to save
17the facility harmless from all financial loss, damage or harm.
18Such liquors may be delivered to and sold at any property owned
19or held under lease by a Metropolitan Pier and Exposition
20Authority or Metropolitan Exposition and Auditorium Authority.
21    Beer and wine may be sold and dispensed at professional
22sporting events and at professional concerts and other
23entertainment events conducted on premises owned by the Forest
24Preserve District of Kane County, subject to the control of the
25District Commissioners and applicable local law, provided that
26dram shop liability insurance is provided at maximum coverage

1limits so as to hold the District harmless from all financial
2loss, damage and harm.
3    Nothing in this Section shall preclude the sale or delivery
4of beer and wine at a State or county fair or the sale or
5delivery of beer or wine at a city fair in any otherwise lawful
6manner.
7    Alcoholic liquors may be sold at retail in buildings in
8State parks under the control of the Department of Natural
9Resources, provided:
10        a. the State park has overnight lodging facilities with
11    some restaurant facilities or, not having overnight
12    lodging facilities, has restaurant facilities which serve
13    complete luncheon and dinner or supper meals,
14        b. consent to the issuance of a license to sell
15    alcoholic liquors in the buildings has been filed with the
16    commission by the Department of Natural Resources, and
17        c. the alcoholic liquors are sold by the State park
18    lodge or restaurant concessionaire only during the hours
19    from 11 o'clock a.m. until 12 o'clock midnight.
20    Notwithstanding any other provision of this Act, alcoholic
21    liquor sold by the State park or restaurant concessionaire
22    is not subject to the provisions of Articles IV and IX.
23    Alcoholic liquors may be sold at retail in buildings on
24properties under the control of the Historic Sites and
25Preservation Division of the Historic Preservation Agency or
26the Abraham Lincoln Presidential Library and Museum provided:

1        a. the property has overnight lodging facilities with
2    some restaurant facilities or, not having overnight
3    lodging facilities, has restaurant facilities which serve
4    complete luncheon and dinner or supper meals,
5        b. consent to the issuance of a license to sell
6    alcoholic liquors in the buildings has been filed with the
7    commission by the Historic Sites and Preservation Division
8    of the Historic Preservation Agency or the Abraham Lincoln
9    Presidential Library and Museum, and
10        c. the alcoholic liquors are sold by the lodge or
11    restaurant concessionaire only during the hours from 11
12    o'clock a.m. until 12 o'clock midnight.
13    The sale of alcoholic liquors pursuant to this Section does
14not authorize the establishment and operation of facilities
15commonly called taverns, saloons, bars, cocktail lounges, and
16the like except as a part of lodge and restaurant facilities in
17State parks or golf courses owned by Forest Preserve Districts
18with a population of less than 3,000,000 or municipalities or
19park districts.
20    Alcoholic liquors may be sold at retail in the Springfield
21Administration Building of the Department of Transportation
22and the Illinois State Armory in Springfield; provided, that
23the controlling government authority may consent to such sales
24only if
25        a. the request is from a not-for-profit organization;
26        b. such sales would not impede normal operations of the

1    departments involved;
2        c. the not-for-profit organization provides dram shop
3    liability in maximum insurance coverage limits and agrees
4    to defend, save harmless and indemnify the State of
5    Illinois from all financial loss, damage or harm;
6        d. no such sale shall be made during normal working
7    hours of the State of Illinois; and
8        e. the consent is in writing.
9    Alcoholic liquors may be sold at retail in buildings in
10recreational areas of river conservancy districts under the
11control of, or leased from, the river conservancy districts.
12Such sales are subject to reasonable local regulations as
13provided in Article IV; however, no such regulations may
14prohibit or substantially impair the sale of alcoholic liquors
15on Sundays or Holidays.
16    Alcoholic liquors may be provided in long term care
17facilities owned or operated by a county under Division 5-21 or
185-22 of the Counties Code, when approved by the facility
19operator and not in conflict with the regulations of the
20Illinois Department of Public Health, to residents of the
21facility who have had their consumption of the alcoholic
22liquors provided approved in writing by a physician licensed to
23practice medicine in all its branches.
24    Alcoholic liquors may be delivered to and dispensed in
25State housing assigned to employees of the Department of
26Corrections. No person shall furnish or allow to be furnished

1any alcoholic liquors to any prisoner confined in any jail,
2reformatory, prison or house of correction except upon a
3physician's prescription for medicinal purposes.
4    Alcoholic liquors may be sold at retail or dispensed at the
5Willard Ice Building in Springfield, at the State Library in
6Springfield, and at Illinois State Museum facilities by (1) an
7agency of the State, whether legislative, judicial or
8executive, provided that such agency first obtains written
9permission to sell or dispense alcoholic liquors from the
10controlling government authority, or by (2) a not-for-profit
11organization, provided that such organization:
12        a. Obtains written consent from the controlling
13    government authority;
14        b. Sells or dispenses the alcoholic liquors in a manner
15    that does not impair normal operations of State offices
16    located in the building;
17        c. Sells or dispenses alcoholic liquors only in
18    connection with an official activity in the building;
19        d. Provides, or its catering service provides, dram
20    shop liability insurance in maximum coverage limits and in
21    which the carrier agrees to defend, save harmless and
22    indemnify the State of Illinois from all financial loss,
23    damage or harm arising out of the selling or dispensing of
24    alcoholic liquors.
25    Nothing in this Act shall prevent a not-for-profit
26organization or agency of the State from employing the services

1of a catering establishment for the selling or dispensing of
2alcoholic liquors at authorized functions.
3    The controlling government authority for the Willard Ice
4Building in Springfield shall be the Director of the Department
5of Revenue. The controlling government authority for Illinois
6State Museum facilities shall be the Director of the Illinois
7State Museum. The controlling government authority for the
8State Library in Springfield shall be the Secretary of State.
9    Alcoholic liquors may be delivered to and sold at retail or
10dispensed at any facility, property or building under the
11jurisdiction of the Historic Sites and Preservation Division of
12the Historic Preservation Agency or the Abraham Lincoln
13Presidential Library and Museum where the delivery, sale or
14dispensing is by (1) an agency of the State, whether
15legislative, judicial or executive, provided that such agency
16first obtains written permission to sell or dispense alcoholic
17liquors from a controlling government authority, or by (2) an
18individual or organization provided that such individual or
19organization:
20        a. Obtains written consent from the controlling
21    government authority;
22        b. Sells or dispenses the alcoholic liquors in a manner
23    that does not impair normal workings of State offices or
24    operations located at the facility, property or building;
25        c. Sells or dispenses alcoholic liquors only in
26    connection with an official activity of the individual or

1    organization in the facility, property or building;
2        d. Provides, or its catering service provides, dram
3    shop liability insurance in maximum coverage limits and in
4    which the carrier agrees to defend, save harmless and
5    indemnify the State of Illinois from all financial loss,
6    damage or harm arising out of the selling or dispensing of
7    alcoholic liquors.
8    The controlling government authority for the Historic
9Sites and Preservation Division of the Historic Preservation
10Agency shall be the Director of the Historic Sites and
11Preservation, and the controlling government authority for the
12Abraham Lincoln Presidential Library and Museum shall be the
13Director of the Abraham Lincoln Presidential Library and
14Museum.
15    Alcoholic liquors may be delivered to and sold at retail or
16dispensed for consumption at the Michael Bilandic Building at
17160 North LaSalle Street, Chicago IL 60601, after the normal
18business hours of any day care or child care facility located
19in the building, by (1) a commercial tenant or subtenant
20conducting business on the premises under a lease made pursuant
21to Section 405-315 of the Department of Central Management
22Services Law (20 ILCS 405/405-315), provided that such tenant
23or subtenant who accepts delivery of, sells, or dispenses
24alcoholic liquors shall procure and maintain dram shop
25liability insurance in maximum coverage limits and in which the
26carrier agrees to defend, indemnify, and save harmless the

1State of Illinois from all financial loss, damage, or harm
2arising out of the delivery, sale, or dispensing of alcoholic
3liquors, or by (2) an agency of the State, whether legislative,
4judicial, or executive, provided that such agency first obtains
5written permission to accept delivery of and sell or dispense
6alcoholic liquors from the Director of Central Management
7Services, or by (3) a not-for-profit organization, provided
8that such organization:
9        a. obtains written consent from the Department of
10    Central Management Services;
11        b. accepts delivery of and sells or dispenses the
12    alcoholic liquors in a manner that does not impair normal
13    operations of State offices located in the building;
14        c. accepts delivery of and sells or dispenses alcoholic
15    liquors only in connection with an official activity in the
16    building; and
17        d. provides, or its catering service provides, dram
18    shop liability insurance in maximum coverage limits and in
19    which the carrier agrees to defend, save harmless, and
20    indemnify the State of Illinois from all financial loss,
21    damage, or harm arising out of the selling or dispensing of
22    alcoholic liquors.
23    Nothing in this Act shall prevent a not-for-profit

2    Alcoholic liquors may be sold at retail or dispensed at the
3James R. Thompson Center in Chicago, subject to the provisions
4of Section 7.4 of the State Property Control Act, and 222 South
5College Street in Springfield, Illinois by (1) a commercial
6tenant or subtenant conducting business on the premises under a
7lease or sublease made pursuant to Section 405-315 of the
8Department of Central Management Services Law (20 ILCS
9405/405-315), provided that such tenant or subtenant who sells
10or dispenses alcoholic liquors shall procure and maintain dram
11shop liability insurance in maximum coverage limits and in
12which the carrier agrees to defend, indemnify and save harmless
13the State of Illinois from all financial loss, damage or harm
14arising out of the sale or dispensing of alcoholic liquors, or
15by (2) an agency of the State, whether legislative, judicial or
16executive, provided that such agency first obtains written
17permission to sell or dispense alcoholic liquors from the
18Director of Central Management Services, or by (3) a
19not-for-profit organization, provided that such organization:

10alcoholic liquors at functions authorized by the Director of
11Central Management Services.
12    Alcoholic liquors may be sold or delivered at any facility
13owned by the Illinois Sports Facilities Authority provided that
14dram shop liability insurance has been made available in a
15form, with such coverage and in such amounts as the Authority
16reasonably determines is necessary.
17    Alcoholic liquors may be sold at retail or dispensed at the
18Rockford State Office Building by (1) an agency of the State,
19whether legislative, judicial or executive, provided that such
20agency first obtains written permission to sell or dispense
21alcoholic liquors from the Department of Central Management
22Services, or by (2) a not-for-profit organization, provided
23that such organization:
24        a. Obtains written consent from the Department of
25    Central Management Services;
26        b. Sells or dispenses the alcoholic liquors in a manner

1    that does not impair normal operations of State offices
2    located in the building;
3        c. Sells or dispenses alcoholic liquors only in
4    connection with an official activity in the building;

7    which the carrier agrees to defend, save harmless and
8    indemnify the State of Illinois from all financial loss,
9    damage or harm arising out of the selling or dispensing of
10    alcoholic liquors.
11    Nothing in this Act shall prevent a not-for-profit
12organization or agency of the State from employing the services
13of a catering establishment for the selling or dispensing of
14alcoholic liquors at functions authorized by the Department of
15Central Management Services.
16    Alcoholic liquors may be sold or delivered in a building
17that is owned by McLean County, situated on land owned by the
18county in the City of Bloomington, and used by the McLean
19County Historical Society if the sale or delivery is approved
20by an ordinance adopted by the county board, and the
21municipality in which the building is located may not prohibit
22that sale or delivery, notwithstanding any other provision of
23this Section. The regulation of the sale and delivery of
24alcoholic liquor in a building that is owned by McLean County,
25situated on land owned by the county, and used by the McLean
26County Historical Society as provided in this paragraph is an

1exclusive power and function of the State and is a denial and
2limitation under Article VII, Section 6, subsection (h) of the
3Illinois Constitution of the power of a home rule municipality
4to regulate that sale and delivery.
5    Alcoholic liquors may be sold or delivered in any building
6situated on land held in trust for any school district
7organized under Article 34 of the School Code, if the building
8is not used for school purposes and if the sale or delivery is
9approved by the board of education.
10    Alcoholic liquors may be delivered to and sold at retail in
11any building owned by the Six Mile Regional Library District,
12provided that the delivery and sale is approved by the board of
13trustees of the Six Mile Regional Library District and the
14delivery and sale is limited to a maximum of 6 library district
15events per year. The Six Mile Regional Library District shall
16provide dram shop liability in maximum insurance coverage
17limits so as to save harmless the library district from all
18financial loss, damage, or harm.
19    Alcoholic liquors may be sold or delivered in buildings
20owned by the Community Building Complex Committee of Boone
21County, Illinois if the person or facility selling or
22dispensing the alcoholic liquor has provided dram shop
23liability insurance with coverage and in amounts that the
24Committee reasonably determines are necessary.
25    Alcoholic liquors may be sold or delivered in the building
26located at 1200 Centerville Avenue in Belleville, Illinois and

1occupied by either the Belleville Area Special Education
2District or the Belleville Area Special Services Cooperative.
3    Alcoholic liquors may be delivered to and sold at the Louis
4Joliet Renaissance Center, City Center Campus, located at 214
5N. Ottawa Street, Joliet, and the Food Services/Culinary Arts
6Department facilities, Main Campus, located at 1215 Houbolt
7Road, Joliet, owned by or under the control of Joliet Junior
8College, Illinois Community College District No. 525.
9    Alcoholic liquors may be delivered to and sold at Triton
10College, Illinois Community College District No. 504.
11    Alcoholic liquors may be delivered to and sold at the
12College of DuPage, Illinois Community College District No. 502.
13    Alcoholic liquors may be delivered to and sold at the
14building located at 446 East Hickory Avenue in Apple River,
15Illinois, owned by the Apple River Fire Protection District,
16and occupied by the Apple River Community Association if the
17alcoholic liquor is sold or dispensed only in connection with
18organized functions approved by the Apple River Community
19Association for which the planned attendance is 20 or more
20persons and if the person or facility selling or dispensing the
21alcoholic liquor has provided dram shop liability insurance in
22maximum limits so as to hold harmless the Apple River Fire
23Protection District, the Village of Apple River, and the Apple
24River Community Association from all financial loss, damage,
25and harm.
26    Alcoholic liquors may be delivered to and sold at the Sikia
