2 | | AMENDMENT NO. ______. Amend Senate Bill 2793 by replacing |
3 | | everything after the enacting clause with the following:

4 | | "Section 5. The School Code is amended by adding Section |
5 | | 2-3.160 as follows: |
6 | | (105 ILCS 5/2-3.160 new) |
7 | | Sec. 2-3.160. Student discipline report; school discipline |
8 | | improvement plan. |
9 | | (a) On or before October 31, 2015 and on or before October |
10 | | 31 of each subsequent year, the State Board of Education, |
11 | | through the State Superintendent of Education, shall prepare a |
12 | | report on student discipline in all school districts in this |
13 | | State. This report must be posted on the Internet website of |
14 | | the State Board of Education. The report shall include both of |
15 | | the following: |
16 | | (1) Data on the issuance of out-of-school suspensions, |

1 | | expulsions, and removals to alternative settings, |
2 | | disaggregated by race and ethnicity, gender, age, grade |
3 | | level, limited English proficiency, incident type, and |
4 | | discipline duration. |
5 | | (2) Data on the use of arrests or criminal citations on |
6 | | school grounds and during school hours, disaggregated by |
7 | | race and ethnicity, gender, and age. |
8 | | (b) The State Board of Education shall analyze the data |
9 | | under subsection (a) of this Section on an annual basis and |
10 | | determine the top quartile of school districts for each of the |
11 | | following metrics: |
12 | | (1) Total number of instructional days on which |
13 | | students were excluded because of out-of-school |
14 | | suspensions or expulsions, divided by the total student |
15 | | population. |
16 | | (2) Racial disproportionality with respect to the use |
17 | | of out-of-school suspensions, expulsions, and school-based |
18 | | arrests and criminal citations. |
19 | | The State Board of Education shall require each of the |
20 | | school districts identified in these quartiles to submit a |
21 | | school improvement plan identifying the strategies the school |
22 | | district will implement to reduce the use of harsh disciplinary |
23 | | practices or racial disproportionality or both if applicable. |
24 | | The calculation of the quartile described in subdivision (1) of |
25 | | this subsection (b) shall exclude all school districts that |
26 | | issued fewer than a total of 10 out-of-school suspensions and |

1 | | expulsions during the school year. The calculation of the |
2 | | quartile described in subdivision (2) of this subsection (b) |
3 | | shall exclude all school districts with an enrollment of fewer |
4 | | than 50 white students or fewer than 50 students of color. |
5 | | The plan must be approved at a public school board meeting |
6 | | and posted on the school district's Internet website. Within |
7 | | one year after being identified, the school district shall |
8 | | submit to the State Board of Education and post on the |
9 | | district's Internet website a progress report describing the |
10 | | implementation of the plan and the results achieved.

11 | | Section 99. Effective date. This Act takes effect July 1, |
12 | | 2014.".
