Amends the Workplace Violence Prevention Act. Provides that the Act does not apply to the monitoring of compliance with certain worker safety laws, lawful picketing, or the exercise of the right of free speech or assembly that is otherwise lawful. Effective immediately.

1 | | AN ACT concerning employment.
|
2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Workplace Violence Prevention Act is amended |
5 | | by adding Section 40 as follows: |
6 | | (820 ILCS 275/40 new) |
7 | | Sec. 40. Exemption. |
8 | | (a) This Act does not apply to any individual or |
9 | | organization (i) monitoring or attentive to compliance with |
10 | | public or worker safety laws, wage and hour requirements, or |
11 | | other statutory requirements or (ii) picketing, patrolling, |
12 | | using a banner, or otherwise protesting, occurring at the
|
13 | | workplace that is otherwise lawful and arises out of a bona |
14 | | fide labor
dispute including any controversy concerning wages, |
15 | | salaries, hours, working conditions or benefits, including |
16 | | health and welfare, sick leave, insurance, and pension or |
17 | | retirement provisions, the making or maintaining of collective |
18 | | bargaining agreements, and the terms to be included in those |
19 | | agreements. |
20 | | (b) This Act does not apply to an exercise of the right of |
21 | | free speech or assembly that is
otherwise lawful.
