SYNOPSIS AS INTRODUCED:
 
20 ILCS 2505/2505-65  was 20 ILCS 2505/39b12

    Amends the Department of Revenue Law of the Civil Administrative Code of Illinois. Provides that the Department of Revenue has the power to share information with any State agency that administers at least one means-tested program for the purpose of verifying income eligibility for those programs if the person whose information is being shared consents in writing to the disclosure. Effective immediately.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Department of Revenue Law of the Civil
5Administrative Code of Illinois is amended by changing Section
62505-65 as follows:
 
7    (20 ILCS 2505/2505-65)  (was 20 ILCS 2505/39b12)
8    Sec. 2505-65. Exchange of information.
9    (a) The Department has the power to exchange with any
10state, with any local subdivisions of any state, or with the
11federal government, except when specifically prohibited by
12law, any information that may be necessary to efficient tax
13administration and that may be acquired as a result of the
14administration of the laws set forth in the Sections following
15Section 95-10 and preceding Section 2505-60.
16    (b) The Department has the power to exchange with the
17Department of Healthcare and Family Services information that
18may be necessary for the enforcement of child support orders
19entered pursuant to the Illinois Public Aid Code, the Illinois
20Marriage and Dissolution of Marriage Act, the Non-Support of
21Spouse and Children Act, the Non-Support Punishment Act, the
22Revised Uniform Reciprocal Enforcement of Support Act, the
23Uniform Interstate Family Support Act, or the Illinois

1Parentage Act of 1984. Notwithstanding any provisions in this
2Code to the contrary, the Department of Revenue shall not be
3liable to any person for any disclosure of information to the
4Department of Healthcare and Family Services (formerly
5Illinois Department of Public Aid) under this subsection (b) or
6for any other action taken in good faith to comply with the
7requirements of this subsection (b).
8    (c) The Department has the power to share information with
9any State agency that administers at least one means-tested
10program for the purpose of verifying income eligibility for
11those programs if the person whose information is being shared
12consents in writing to the disclosure. Notwithstanding any
13provisions in this Code to the contrary, the Department of
14Revenue shall not be liable to any person for any disclosure of
15information under this subsection or for any other action taken
16in good faith to comply with the requirements of this
17subsection.

19    Section 99. Effective date. This Act takes effect upon
20becoming law.
