1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Department of Public Health Powers and
5Duties Law of the Civil Administrative Code of Illinois is
6amended by adding Section 2310-685 as follows:
 
7    (20 ILCS 2310/2310-685 new)
8    Sec. 2310-685. Cytomegalovirus public education.
9    (a) In this Section:
10        "CMV" means cytomegalovirus.
11        "Health care provider" means any physician, hospital
12    facility, or other person that is licensed or otherwise
13    authorized to deliver health care services.
14    (b) The Department shall develop or approve and publish
15informational materials for women who may become pregnant,
16expectant parents, and parents of infants regarding:
17        (1) the incidence of CMV;
18        (2) the transmission of CMV to pregnant women and women
19    who may become pregnant;
20        (3) birth defects caused by congenital CMV;
21        (4) methods of diagnosing congenital CMV; and
22        (5) available preventive measures to avoid the
23    infection of women who are pregnant or may become pregnant.

1    (c) The Department shall publish the information required
2under subsection (b) on its Internet website.
3    (d) The Department shall publish information to:
4        (1) educate women who may become pregnant, expectant
5    parents, and parents of infants about CMV; and
6        (2) raise awareness of CMV among health care providers
7    who provide care to expectant mothers or infants.
8    (e) The Department may solicit and accept the assistance of
9any relevant medical associations or community resources,
10including faith-based resources, to promote education about
11CMV under this Section.
12    (f) If a newborn infant fails the 2 initial hearing
13screenings in the hospital, then the hospital performing that
14screening shall provide to the parents of the newborn infant
15information regarding: (i) birth defects caused by congenital
16CMV; (ii) testing opportunities and options for CMV, including
17the opportunity to test for CMV before leaving the hospital;
18and (iii) early intervention services. Health care providers
19may use the materials developed by the Department for
20distribution to parents of newborn infants.
