| 1 | AMENDMENT TO HOUSE BILL 735

| 2 | AMENDMENT NO. ______. Amend House Bill 735 by replacing | ||||||
| 3 | everything after the enacting clause with the following:

| 4 | "Section 5. The Illinois Municipal Code is amended by | ||||||
| 5 | adding Section 8-1-2.10 as follows: | ||||||
| 6 | (65 ILCS 5/8-1-2.10 new) | ||||||
| 7 | Sec. 8-1-2.10. Use of municipal funds for advertisements. | ||||||
| 8 | No advertisement may be purchased using municipal funds that | ||||||
| 9 | would include the name of any person holding an elected office. | ||||||
| 10 | For purposes of this Section, "advertisement" means any type of | ||||||
| 11 | announcement that is purchased for promotional purposes for | ||||||
| 12 | print in a book, publication, brochure, sign, or digital media. | ||||||
| 13 | "Advertisement" does not include a newsletter or publication | ||||||
| 14 | providing information pertaining to the community that is | ||||||
| 15 | distributed to residents and businesses within the community, | ||||||
| 16 | brochures or similar informational materials that announce or | ||||||
| |||||||
| |||||||
| 1 | describe community events or activities such as conservation or | ||||||
| 2 | recreational programs or festivals or other similar events. In | ||||||
| 3 | addition, "advertisement" does not include a welcome sign | ||||||
| 4 | posted upon entering a community, neighborhood, or a sign | ||||||
| 5 | located at a governmental facility or project. | ||||||
| 6 | A violation of this Section shall result in the person or | ||||||
| 7 | persons who caused the municipal funds to be expended repaying | ||||||
| 8 | the municipal funds used for the advertisement plus a $100 | ||||||
| 9 | assessment payable to the municipality. A second violation of | ||||||
| 10 | this Section will result in the person or persons who caused | ||||||
| 11 | the municipal funds to be expended repaying the municipal funds | ||||||
| 12 | used for the advertisement plus a $250 assessment payable to | ||||||
| 13 | the municipality. A third and any subsequent violations of this | ||||||
| 14 | Section will result in the person or persons who caused the | ||||||
| 15 | municipal funds to be expended repaying the municipal funds | ||||||
| 16 | used for the advertisement plus a $500 assessment payable to | ||||||
| 17 | the municipality.".
