AMENDMENT TO HOUSE BILL 1401

2    AMENDMENT NO. ______. Amend House Bill 1401 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Municipal Code is amended by
5changing Sections 3.1-10-65, 3.1-10-75, 3.1-15-40, and
63.1-20-22 as follows:
 
7    (65 ILCS 5/3.1-10-65)  (from Ch. 24, par. 3.1-10-65)
8    Sec. 3.1-10-65. Referendum to reduce terms.
9    (a) Except as otherwise provided in subsection (c), in In
10any municipality of less than 500,000 inhabitants, a
11proposition to reduce the terms of the elective officers of the
12municipality from 4 years to 2 years may be submitted, within
13the discretion of the corporate authorities, to the electors of
14the municipality. The proposition shall also be submitted if a
15petition requesting that action is signed by electors of the
16municipality numbering not less than 10% of the total vote cast

1at the last election for mayor or president of the municipality
2and the petition is filed with the municipal clerk and
3certified in accordance with the general election law. The
4proposition shall be substantially in the following form:
5        Shall the term of the elective officers of (name of
6    municipality) be reduced from 4 years to 2 years?
7    (b) If a majority of the electors voting on the proposition
8vote against it, the terms of the officers shall remain 4
9years. If, however, a majority of those voting on the
10proposition vote in favor of it, the officers elected at the
11next regular election for officers in the municipality shall
12hold their offices for a term of 2 years and until their
13successors are elected and have qualified, except in the case
14of trustees and aldermen. In the case of aldermen and trustees:
15(i) at the first election of aldermen or trustees that occurs
16in an odd numbered year following the vote to reduce the length
17of terms, successors to aldermen or trustees whose terms expire
18in that year shall be elected for a term of one year and until
19their successors are elected and have qualified and (ii)
20thereafter, one-half of the aldermen or trustees shall be
21elected each year for terms of 2 years and until their
22successors are elected and have qualified.
23    (c) On or after 60 days from the effective date of this
24amendatory Act of the 99th General Assembly, the corporate
25authorities of each municipality with a population of less than
2640,000, where the length of the terms of aldermen or trustees

1are 2 years, shall by lot designate one-half of their number
2whose terms shall be extended to 4 years. Within 7 days after
3the corporate authorities determine by lot the extension of the
4aldermen's or trustees' terms, but no later than August 1,
52015, the corporate authorities shall report and certify to the
6election authority the aldermen or trustees whose terms have
7been extended. Thereafter, all aldermen or trustees shall be
8elected for terms of 4 years.
9    Notwithstanding the provisions of subsections (a) and (b),
10on and after the effective date of this amendatory Act of the
1199th General Assembly, a municipality with a population of less
12than 40,000 may not reduce the length of terms of its aldermen
13or trustees from 4 years to 2 years by referendum or otherwise.

17    (a) Except as otherwise provided in subsection (c), in In

20officers, a proposition to lengthen the terms of the elective
21officers of the municipality from 2 years to 4 years may be
22submitted, within the discretion of the corporate authorities,

24certified by the municipal clerk to the appropriate election
25authorities, who shall submit the proposition at an election in

2also be submitted at an election if a petition requesting that
3action is signed by electors of the municipality numbering not
4less than 10% of the total vote cast at the last election for
5mayor or president of the municipality and the petition is
6filed with the municipal clerk. The proposition shall be
7substantially in the following form:
8        Shall the term of the elective officers of (name of
9    municipality) be lengthened from 2 years to 4 years?
10    (b) If a majority of the electors voting on the proposition
11vote against it, the terms of the officers shall remain 2
12years. If, however, a majority of those voting on the
13proposition vote in favor of it, the officers elected at the
14next regular election for officers in the municipality shall
15hold their offices for a term of 4 years and until their
16successors are elected and have qualified, except in the case
17of trustees and aldermen. In the case of aldermen and trustees:
18(i) if the first election for aldermen or trustees, after
19approval of the proposition, occurs in an even numbered year,
20the aldermen or trustees elected in that even numbered year
21shall serve for terms of 3 years and until their successors are
22elected and have qualified, the terms for successors to those
23elected at the first even numbered year election shall be 4
24years and until successors are elected and have qualified, the
25aldermen or trustees elected at the first odd numbered year
26election next following the first even numbered year election

1shall serve for terms of 4 years and until successors are
2elected and have qualified, and successors elected after the
3first odd numbered year shall also serve 4 year terms and until
4their successors are elected and have qualified and (ii) if the
5first election for aldermen or trustees, after approval of the
6proposition, occurs in an odd numbered year, the aldermen or
7trustees elected in that odd numbered year shall serve for
8terms of 4 years and until their successors are elected and
9have qualified, the terms for successors to those elected at
10the first odd numbered year election shall be for 4 years and
11until successors are elected and have qualified, the aldermen
12or trustees elected at the first even numbered year election
13next following the first odd numbered year election shall serve
14for terms of one year and until their successors are elected
15and have qualified, and the terms for successors to those
16elected at the first odd numbered year election shall be 4
17years and until their successors are elected and have
18qualified.
19    (c) Notwithstanding the provisions of subsections (a) and
20(b), on or after 60 days from the effective date of this
21amendatory Act of the 99th General Assembly, the corporate
22authorities of each municipality with a population of less than
2340,000, where the length of the terms of aldermen or trustees
24are 2 years, shall by lot designate one-half of their number

9On or after 60 days from the effective date of this amendatory
10Act of the 99th General Assembly, the corporate authorities of
11each municipality with a population of less than 40,000, where
12the length of the terms of aldermen or trustees are 2 years,
13shall by lot designate one-half of their number whose terms
14shall be extended to 4 years. Within 7 days after the corporate
15authorities determine by lot the extension of the aldermen's or
16trustees' terms, but no later than August 1, 2015, the
17corporate authorities shall report and certify to the election
18authority the aldermen or trustees whose terms have been
19extended. Thereafter, all aldermen or trustees shall be elected
20for terms of 4 years. In all other cities that adopt or have
21adopted the minority representation plan for the election of
22aldermen and have not already staggered the terms of their
23aldermen, the city council may provide by ordinance that at any
24ensuing general municipal election for city officers the
25aldermen in every alternate district shall be elected for one

1term of 2 years and, at the expiration of that term of 2 years,
2for regular terms of 4 years. This Section does not prohibit a
3city from voting in favor of a 2 year term for city officers as
4provided in Section 3.1-10-65. The provisions of the general
5election law shall govern elections under this Section.

8    Sec. 3.1-20-22. Aldermen; staggered terms.
9    (a) Except as otherwise provided in subsection (b), in In
10any city of less than 100,000 inhabitants, a proposition to
11stagger the terms of aldermen, with as nearly as possible
12one-half of the aldermen elected every 2 years, shall be
13certified by the city clerk to the proper election authority,
14who shall submit the proposition at an election in accordance
15with the general election law, if a petition requesting that
16action is signed by electors of the city numbering at least 10%
17of the total vote cast at the last election for mayor of the
18city and is filed with the city clerk.
19    The ballot shall have printed on it, but not as a part of
20the proposition submitted, the following information for
21voters: one alderman elected from each even-numbered ward shall
22serve a term of 2 years; one alderman elected from each
23odd-numbered ward shall serve a term of 4 years.
24    The proposition shall be substantially in the following

1        Shall (name of city) adopt a system of staggered terms
2    for aldermen?
3    If a majority of those voting on the proposition vote in
4favor of it, then at the next regular election for aldermen one
5alderman shall be elected from each even-numbered ward for a
6term of 2 years and one alderman shall be elected from each
7odd-numbered ward for a term of 4 years. Thereafter, their
8successors shall be elected for terms of 4 years.
9    (b) On or after 60 days from the effective date of this
10amendatory Act of the 99th General Assembly, the corporate
11authorities of each municipality with a population of less than
1240,000, where the length of the terms of aldermen or trustees
13are 2 years, shall by lot designate one-half of their number
14whose terms shall be extended to 4 years. Within 7 days after
15the corporate authorities determine by lot the extension of the
16aldermen's or trustees' terms, but no later than August 1,
172015, the corporate authorities shall report and certify to the
18election authority the aldermen or trustees whose terms have
19been extended. Thereafter, all aldermen or trustees shall be
20elected for terms of 4 years.
