    Amends the Environmental Protection Act. Provides that "pollution control waste", "sludge", and "waste" do not include exceptional quality biosolids. Defines "exceptional quality biosolids".

1    AN ACT concerning safety.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Environmental Protection Act is amended by
5changing Sections 3.335, 3.465, and 3.535 and by adding Section
63.560 as follows:
 
7    (415 ILCS 5/3.335)  (was 415 ILCS 5/3.27)
8    Sec. 3.335. Pollution control waste. "Pollution control
9waste" means any liquid, solid, semi-solid or gaseous waste
10generated as a direct or indirect result of the removal of
11contaminants from the air, water or land, and which pose a
12present or potential threat to human health or to the
13environment or with inherent properties which make the disposal
14of such waste in a landfill difficult to manage by normal
15means. "Pollution control waste" includes but is not limited to
16water and wastewater treatment plant sludges, baghouse dusts,
17landfill waste, scrubber sludges and chemical spill cleanings.
18"Pollution control waste" does not include exceptional quality
19biosolids.

22    Sec. 3.465. Sludge. "Sludge" means any solid, semi-solid,

1or liquid waste generated from a municipal, commercial, or
2industrial wastewater treatment plant, water supply treatment
3plant, or air pollution control facility or any other such
4waste having similar characteristics and effects. "Sludge"
5does not include exceptional quality biosolids.

8    Sec. 3.535. Waste. "Waste" means any garbage, sludge from
9a waste treatment plant, water supply treatment plant, or air
10pollution control facility or other discarded material,
11including solid, liquid, semi-solid, or contained gaseous
12material resulting from industrial, commercial, mining and
13agricultural operations, and from community activities, but
14does not include solid or dissolved material in domestic
15sewage, exceptional quality biosolids, or solid or dissolved
16materials in irrigation return flows, or coal combustion
17by-products as defined in Section 3.135, or industrial
18discharges which are point sources subject to permits under
19Section 402 of the Federal Water Pollution Control Act, as now
20or hereafter amended, or source, special nuclear, or by-product
21materials as defined by the Atomic Energy Act of 1954, as
22amended (68 Stat. 921) or any solid or dissolved material from
23any facility subject to the Federal Surface Mining Control and
24Reclamation Act of 1977 (P.L. 95-87) or the rules and
25regulations thereunder or any law or rule or regulation adopted

1by the State of Illinois pursuant thereto.

3    (415 ILCS 5/3.560 new)
4    Sec. 3.560. Exceptional quality biosolids. "Exceptional
5quality biosolids" means solids produced by advanced treatment
6of wastewater treatment plant sludge through stabilization and
7other processes to meet the following requirements of 40 C.F.R.
8Part 503: the pollutant concentrations in Table 3 of Section
9503.13(b), the Class A pathogen requirements in Section 503.32,
10and one of the vector attraction requirements in Section
11503.33(b)(1)-(8).
