1 | | AN ACT concerning transportation.
|
2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Illinois Vehicle Code is amended by changing |
5 | | Section 18b-108 as follows:
|
6 | | (625 ILCS 5/18b-108) (from Ch. 95 1/2, par. 18b-108)
|
7 | | Sec. 18b-108. Violations; Criminal penalties.
|
8 | | (a) The provisions of Chapter 16 shall be applicable to |
9 | | acts committed
by a driver of a motor vehicle that violate this |
10 | | Chapter or any rule or
regulation issued under this Chapter.
|
11 | | (b) Except as provided in subsection (d), any Any driver |
12 | | who willfully violates any provision of this Chapter or
any |
13 | | rule or regulation issued under this Chapter is guilty of a |
14 | | Class 4
felony. In addition to any other penalties prescribed |
15 | | by law, the maximum
fine for each offense is $10,000.
Such |
16 | | violation shall be prosecuted by the State's Attorney or the |
17 | | Attorney
General.

18 | | (c) Except as provided in subsection (d), any Any person, |
19 | | other than a driver, who willfully
violates or causes another |
20 | | to violate any provision of this Chapter or any
rule or |
21 | | regulation issued
under this Chapter is guilty of a Class 3 |
22 | | felony. In addition to any other
penalties prescribed by law, |
23 | | the maximum fine for each offense is $25,000.

2 | | State's Attorney or the Attorney General. |
3 | | (d) Any driver who willfully violates Parts 392, 395, |
4 | | Sections 391.11, 391.15, 391.41, or 391.45 of Part 391, or any |
5 | | other Part of Title 49 of the Code of Federal Regulations, as |
6 | | adopted by reference in Section 18b-105 of this Code, which |
7 | | would place the driver or vehicle out of service, when the |
8 | | violation results in a motor vehicle accident that causes great |
9 | | bodily harm, permanent disability or disfigurement, or death to |
10 | | another person, is guilty of a Class 3 felony. Any person other |
11 | | than the driver who willfully violates Parts 392, 395, Sections |
12 | | 391.11, 391.15, 391.41, or 391.45 of Part 391 or any other Part |
13 | | of Title 49 of the Code of Federal Regulations, as adopted by |
14 | | reference in Section 18b-105 of this Code, which would place |
15 | | the driver or vehicle out of service, when the violation |
16 | | results in a motor vehicle accident that causes great bodily |
17 | | harm, permanent disability or disfigurement, or death to |
18 | | another person, is guilty of a Class 2 felony.
