2 | | (c) Except as provided in subsection (d), any Any person, |
3 | | other than a driver, who willfully
violates or causes another |
4 | | to violate any provision of this Chapter or any
rule or |
5 | | regulation issued
under this Chapter is guilty of a Class 3 |
6 | | felony. In addition to any other
penalties prescribed by law, |
7 | | the maximum fine for each offense is $25,000.
Such violation |
8 | | shall be prosecuted
at the request of the Department
by the |
9 | | State's Attorney or the Attorney General. |
10 | | (d) Any driver who willfully violates Parts 392, 395, or |
11 | | Section 391.41 of Part 391 of Title 49 of the Code of Federal |
12 | | Regulations, as adopted by reference in Section 18b-105 of this |
13 | | Code, when the violation results in a motor vehicle accident |
14 | | that causes great bodily harm, permanent disability or |
15 | | disfigurement, or death to another person, is guilty of a Class |
16 | | 3 felony. Any person other than the driver who willfully |
17 | | violates Parts 392, 395, or Section 391.41 of Part 391 of Title |
18 | | 49 of the Code of Federal Regulations, as adopted by reference |
19 | | in Section 18b-105 of this Code, when the violation results in |
20 | | a motor vehicle accident that causes great bodily harm, |
21 | | permanent disability or disfigurement, or death to another |
22 | | person, is guilty of a Class 2 felony.
