2 | | AMENDMENT NO. ______. Amend House Bill 3163 by replacing |
3 | | everything after the enacting clause with the following:

4 | | "Section 5. The Coal Mining Act is amended by adding |
5 | | Section 1.25 and by changing Sections 5.11, 6.10, and 6.11 as |
6 | | follows: |
7 | | (225 ILCS 705/1.25 new) |
8 | | Sec. 1.25. Recorder. "Recorder" means a person with a mine |
9 | | manager certification or mine examiner certification, trained |
10 | | and designated by the operator as the individual responsible |
11 | | for recording the mine examiner's examination of the |
12 | | underground workings of the mine.

14 | | Sec. 5.11.
To see that a mine examiner makes the |
15 | | examinations provided in
Articles 5, 6, and 31 of this Act, and |

1 | | that he or she enters his or her report by calling it out to the |
2 | | surface to either a recorder or mine examiner to record the |
3 | | report in a book or computer system that is thereof
with |
4 | | indelible pencil or ink in a well-bound or properly protected |
5 | | loose
leaf book provided by the operator for that purpose , and |
6 | | the book or computer system shall be secure and not susceptible |
7 | | to alteration .

10 | | Sec. 6.10.
Upon completing his or her examination, he or |
11 | | she shall make a daily record of
the same either by calling out |
12 | | the results of the examination to a recorder or by personally |
13 | | recording the report. The recorder or mine examiner shall |
14 | | record the report in a book or computer system that is provided |
15 | | by the operator for that purpose, and the book or computer |
16 | | system shall be secure and not susceptible to alteration. The |
17 | | mine examination is in a book kept for that purpose, for the |
18 | | information of the
company, the State Mine Inspector and all |
19 | | other persons interested; and
this report shall be recorded |
20 | | before the miners are permitted to enter the mine. If the |
21 | | record is made by someone other than the examiner, then the |
22 | | examiner shall verify the record by initials and date record |
23 | | shall be made each morning before the miners are permitted to

24 | | enter the mine.

2 | | Sec. 6.11.
Should any dangerous conditions be found as |
3 | | described in Section
6.09, he or she shall call the conditions |
4 | | out to a recorder or shall personally record the report. The |
5 | | recorder or mine examiner shall record the report in a book or |
6 | | computer system that is provided by the operator for that |
7 | | purpose, and the book or computer system shall be secure and |
8 | | not susceptible to alteration. The recorder or mine examiner |
9 | | shall ensure that the report sets record the same in the daily |
10 | | record book of examinations,
setting forth the nature of the |
11 | | conditions found and the location of same. If the mine |
12 | | examiner, upon verifying the mine examiner book, notes an |
13 | | omission or error, he or she shall immediately notify the shift |
14 | | mine manager and make the necessary revisions to the pre-shift |
15 | | book.
