AMENDMENT TO HOUSE BILL 3163

2    AMENDMENT NO. ______. Amend House Bill 3163 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Coal Mining Act is amended by adding
5Section 1.25 and by changing Sections 5.11, 6.10, and 6.11 as
6follows:
 
7    (225 ILCS 705/1.25 new)
8    Sec. 1.25. Recorder. "Recorder" means a person with a mine
9manager certification or mine examiner certification, trained
10and designated by the operator as the individual responsible
11for recording the mine examiner's examination of the
12underground workings of the mine.

14    Sec. 5.11. To see that a mine examiner makes the
15examinations provided in Articles 5, 6, and 31 of this Act, and

1that he or she enters his or her report either by calling it
2out to the surface to a recorder or by personally recording the
3report. The recorder or mine examiner shall record the report
4in a book or computer system that is provided by the operator
5for that purpose, and the book or computer system shall be
6secure and not susceptible to alteration. thereof with
7indelible pencil or ink in a well-bound or properly protected
8loose leaf book provided by the operator for that purpose.

11    Sec. 6.10. Upon completing his or her examination, he or
12she shall make a daily record of the same either by calling out
13the results of the examination to a recorder or by personally
14recording the report. The recorder or mine examiner shall
15record the report in a book or computer system that is provided
16by the operator for that purpose, and the book or computer
17system shall be secure and not susceptible to alteration. The
18mine examination is in a book kept for that purpose, for the
19information of the company, the State Mine Inspector and all
20other persons interested; and this report shall be recorded
21before the miners are permitted to enter the mine. If the
22record is made by someone other than the examiner, then the
23examiner shall verify the record by initials and date record
24shall be made each morning before the miners are permitted to
25enter the mine.

3    Sec. 6.11. Should any dangerous conditions be found as
4described in Section 6.09, he or she shall call the conditions
5out to a recorder or shall personally record the report. The
6recorder or mine examiner shall record the report in a book or
7computer system that is provided by the operator for that
8purpose, and the book or computer system shall be secure and
9not susceptible to alteration. The recorder or mine examiner
10shall ensure that the report sets record the same in the daily
11record book of examinations, setting forth the nature of the
12conditions found and the location of same. If the mine
13examiner, upon verifying the mine examiner book, notes an
14omission or error, he or she shall immediately notify the shift
15mine manager and make the necessary revisions to the pre-shift
16book.

18    Section 99. Effective date. This Act takes effect upon
19becoming law.".
