SYNOPSIS AS INTRODUCED:
 

 
New Act

     Creates the   Sale of Flavored Electronic Cigarettes and Flavored Cigarette Liquids Prohibition Act. Creates the offense of  unlawful sale of flavored electronic cigarettes or flavored cigarette liquids.  Provides that a person commits unlawful sale of flavored electronic cigarettes or flavored cigarette liquids when he or she knowingly sells flavored electronic
cigarettes or flavored
cigarette liquids, or causes, permits, or procures flavored electronic cigarettes or flavored
cigarette liquids to be sold from his or her
premises or establishment.  Provides that a violation is a Class A misdemeanor.  Defines "electronic cigarette", "electronic cigarette liquids", "flavored electronic cigarette", and "flavored cigarette liquids".

1    AN ACT concerning business.
  
 
2    WHEREAS, It is the intent of the General Assembly to 
3curtail addiction to nicotine by the use  of electronic 
4cigarettes; therefore
 
5    Be it enacted by the People of the State of Illinois,
 
6represented in the General Assembly:
  
 
 
7    Section 1. Short title. This Act may be cited as the  Sale 
8of Flavored Electronic Cigarettes and Flavored Cigarette 
9Liquids Prohibition Act.
 
10    Section 5. Definitions. In this Act:
11    "Electronic cigarette" or "e-cigarette" means a 
12battery-operated
device that contains a combination of 
13nicotine, flavor, or chemicals or any
combination thereof that 
14are turned into vapor which is inhaled by the user.
15    "Electronic cigarette liquids" means liquids sold and

16marketed for the refilling of e-cigarettes.
17    "Flavored cigarette liquids" means any liquids sold and

18marketed for the refilling of e-cigarettes that produce a 
19flavor other than tobacco or
menthol.
20    "Flavored electronic cigarette" means an electronic 
21cigarette with a flavor, or chemical or any combination of 
22chemicals that produces a flavor other than tobacco or menthol

1in electronic cigarettes.
 
2    Section 10. Unlawful sale. A person commits unlawful sale 
3of flavored electronic cigarettes or flavored cigarette 
4liquids when he or she knowingly sells flavored electronic

5cigarettes or flavored
cigarette liquids, or causes, permits, 
6or procures flavored electronic cigarettes or flavored

7cigarette liquids to be sold from his or her
premises or 
8establishment.
 
9    Section 15. Penalty. Unlawful sale of flavored electronic 
10cigarettes or flavored cigarette liquids is a Class A 
11misdemeanor.
