2 | | AMENDMENT NO. ______. Amend House Bill 3887 by replacing |
3 | | everything after the enacting clause with the following:

4 | | "Section 5. The Business Assistance and Regulatory Reform |
5 | | Act is amended by adding Section 20 as follows: |
6 | | (20 ILCS 608/20 new) |
7 | | Sec. 20. Review of rules and regulations; reporting. |
8 | | (a) As used in this Section: |
9 | | "Small business" means a corporation or a concern, |
10 | | including its affiliates, that is independently owned and |
11 | | operated, not dominant in its field, and employs fewer than 50 |
12 | | full-time employees or has gross annual sales of less than |
13 | | $4,000,000. For purposes of a specific rule, an agency may |
14 | | define small business to include employment of 50 or more |
15 | | persons if it finds that such a definition is necessary to |
16 | | adapt the rule to the needs and problems of small businesses |

1 | | and organizations. |
2 | | "State agencies" means all officers, boards, commissions, |
3 | | and agencies of the executive branch, including all officers, |
4 | | departments, boards, commissions, agencies, institutions, |
5 | | authorities, universities, and bodies politic and corporate |
6 | | thereof; and administrative units or corporate outgrowths of |
7 | | the State government which are created by or pursuant to |
8 | | statute, other than units of local government and their |
9 | | officers, school districts and boards of election |
10 | | commissioners; all administrative units and corporate |
11 | | outgrowths of the above and as may be created by executive |
12 | | order of the Governor. |
13 | | (b) Each State agency shall scrutinize its rules, |
14 | | administrative regulations, and permitting processes as they |
15 | | pertain to small businesses in order to identify those rules, |
16 | | regulations, and processes that are unreasonable, unduly |
17 | | burdensome, duplicative, or onerous to small businesses. The |
18 | | goal of this review is for each State agency to: |
19 | | (1) recommend changes that will lessen the reporting |
20 | | and paper work requirements on small businesses while still |
21 | | achieving the intent of the underlying statute; |
22 | | (2) eliminate unnecessary or antiquated permit |
23 | | requirements; |
24 | | (3) consolidate duplicative or overlapping permit |
25 | | requirements; |
26 | | (4) simplify overly complex or lengthy application |

1 | | procedures; and |
2 | | (5) expedite time-consuming agency review and approval |
3 | | procedures. |
4 | | (c) Each State agency must conduct its initial review of |
5 | | its rules, regulations, and permitting processes under |
6 | | subsection (b) of this Section within one year of the effective |
7 | | date of this amendatory Act of the 99th General Assembly, and |
8 | | every 5 years thereafter. At the conclusion of each review, |
9 | | each State agency must issue a report containing the results |
10 | | from its review and any recommendations to the Office of |
11 | | Business Permits and Regulatory Assistance, the Governor, and |
12 | | the General Assembly. ".
