SYNOPSIS AS INTRODUCED:
 
410 ILCS 535/21.7 new

    Amends the Vital Records Act. Provides that a funeral director may arrange for the transport of a dead body to a location outside of Illinois for a period not to exceed 36 hours for the purpose of organ donation, tissue harvesting, or autopsy. Provides that the funeral director is not required to obtain a permit for transportation from the Department of Public Health or local health department prior to transporting the body; rather, the funeral director shall complete and transport with the body documentation as required by the Department of Public Health. Provides that the funeral director shall provide a copy of the documentation to the medical examiner or coroner having jurisdiction over the body, and that the documentation shall serve as notice that the body is being transported outside of Illinois for a period not to exceed 36 hours. Directs the Department of Public Health to adopt rules to implement the new provisions. Provides that the new provisions apply only if the dead body is to be returned to Illinois prior to disposition.

1    AN ACT concerning health.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Vital Records Act is amended by adding
5Section 21.7 as follows:
 
6    (410 ILCS 535/21.7 new)
7    Sec. 21.7. Temporary removal of a dead body.
8    (a) A funeral director may arrange for the transport of a
9dead body to a location outside of this State for a period not
10to exceed 36 hours for the purpose of organ donation, tissue
11harvesting, or autopsy.
12    (b) The funeral director is not required to obtain a permit
13for transportation from the Department of Public Health or
14local health department prior to transporting the body. Rather,
15the funeral director shall complete and transport with the body
16documentation as required by the Department of Public Health.
17The funeral director shall provide a copy of the documentation
18to the medical examiner or coroner having jurisdiction over the
19body. The documentation shall serve as notice that the body is
20being transported outside of this State for a period not to
21exceed 36 hours.
22    (c) The Department of Public Health shall adopt rules to
23implement this Section.
