AMENDMENT TO HOUSE BILL 4334

2    AMENDMENT NO. ______. Amend House Bill 4334 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Vehicle Code is amended by
5changing Section 3-821.2 as follows:
 
6    (625 ILCS 5/3-821.2)
7    Sec. 3-821.2. Delinquent registration renewal fee.
8    (a) For registration renewal periods beginning on or after
9January 1, 2005, the Secretary of State may impose a delinquent
10registration renewal fee of $20 for the registration renewal of
11all passenger vehicles of the first division and motor vehicles
12of the second division weighing not more than 8,000 pounds if
13the application for registration renewal is received by the
14Secretary more than one month after the expiration of the most
15recent period during which the vehicle was registered. If a
16delinquent registration renewal fee is imposed, the Secretary

1shall not renew the registration of such a vehicle until the
2delinquent registration renewal fee has been paid, in addition
3to any other registration fees owed for the vehicle. Active
4duty military personnel stationed outside of Illinois shall not
5be required to pay the delinquent registration renewal fee. If
6a delinquent registration renewal fee is imposed, the Secretary
7shall adopt rules for the implementation of this Section. All
8fees collected under this Section shall be deposited into the
9General Revenue Fund.
10    (b) Notwithstanding the provisions of subsection (a), the
11Secretary of State shall not impose a delinquent registration
12renewal fee for the registration renewal of all passenger
13vehicles of the first division and motor vehicles of the second
14division weighing not more than 8,000 pounds if a vehicle's
15registration expires during a period of time in which no
16notice, by U.S. mail, was sent to the vehicle owner by the
17Secretary. Any local, county, municipal, or state law
18enforcement agency may not issue a citation for an expired
19registration until one month after the expiration of the
20registration under this subsection (b). If the Secretary
21resumes mailing registration renewal notices, then the
22Secretary may resume the collection of the delinquent
23registration renewal fee under subsection (a), and any local,
24county, municipal, or state law enforcement agency may resume
25citing any vehicle with an expired registration without waiting
26the one month period required by this subsection (b). The

1changes made by this amendatory Act of the 99th General
2Assembly apply only to vehicle registrations that expire on or
3after the effective date of this amendatory Act of the 99th
4General Assembly.
