1    AN ACT concerning civil law.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Adoption Act is amended by changing Section
518.4 as follows:
 
6    (750 ILCS 50/18.4)  (from Ch. 40, par. 1522.4)
7    Sec. 18.4. (a) The agency, Department of Children and
8Family Services, Court Supportive Services, Juvenile Division
9of the Circuit Court, or the Probation Officers of the Circuit
10Court involved in the adoption proceedings shall give in
11writing the following non-identifying information, if known,
12to the adoptive parents not later than the date of placement
13with the petitioning adoptive parents: (i) age of biological
14parents; (ii) their race, religion and ethnic background; (iii)
15general physical appearance of biological parents; (iv) their
16education, occupation, hobbies, interests and talents; (v)
17existence of any other children born to the biological parents;
18(vi) information about biological grandparents; reason for
19emigrating into the United States, if applicable, and country
20of origin; (vii) relationship between biological parents;
21(viii) detailed medical and mental health histories of the
22child, the biological parents, and their immediate relatives;
23and (ix) the actual date and place of birth of the adopted

1person; and (x) the reason or reasons the birth parent or
2parents stated for placing the child for adoption, how and why
3the adoptive parent or parents were selected and who selected
4the adoptive parent or parents, and whether the birth parent or
5parents requested or agreed to post-adoption contact with the
6child at the time of placement, and, if so, the frequency and
7type of contact. However, no information provided under this
8subsection shall disclose the name or last known address of the
9biological parents, grandparents, the siblings of the
10biological parents, the adopted person, or any other relative
11of the adopted person.
12    (b) Any adoptee 18 years of age or over shall be given the
13information in subsection (a) upon request.
14    (c) The Illinois Adoption Registry shall release any
15non-identifying information listed in (a) of this Section that
16appears on the certified copy of the original birth certificate
17or the Certificate of Adoption to an adopted person, adoptive
18parent, or legal guardian who is a registrant of the Illinois
19Adoption Registry.
20    (d) The Illinois Adoption Registry shall release the actual
21date and place of birth of an adopted person who is 21 years of
22age or over to the birth parent if the birth parent is a
23registrant of the Illinois Adoption Registry and has completed
24a Medical Information Exchange Authorization.
25    (e) The Illinois Adoption Registry shall release
26information regarding the date the adoption was finalized and

1the county in which the adoption was finalized to a certified
2confidential intermediary upon submission of a court order.
3    (f) In cases where the Illinois Adoption Registry possesses
4information indicating that an adopted person who is 21 years
5of age or over was adopted in a state other than Illinois or a
6country other than the United States, the Illinois Adoption
7Registry shall release the name of the state or country where
8the adoption was finalized and, if available, the agency
9involved in the adoption to a registrant of the Illinois
10Adoption Registry, provided the registrant is not the subject
11of a Denial of Information Exchange and the registrant has
12completed a Medical Information Exchange Authorization.
13    (g) Any of the above available information for any adoption
14proceedings completed before the effective date of this Act
15shall be supplied to the adoptive parents or an adoptee 18
16years of age or over upon request.
17    (h) The agency, Department of Children and Family Services,
18Court Supportive Services, Juvenile Division of the Circuit
19Court, the Probation Officers of the Circuit Court and any
20other governmental bodies having any of the above information
21shall retain the file until the adoptee would have reached the
22age of 99 years.
