2 | | Be it enacted by the People of the State of Illinois, |
3 | | represented in the General Assembly:

4 | | Section 5. The Prisoner Interchange Act is amended by |
5 | | changing Section 1 as follows:
|

The
The warden or superintendent of any penal |
8 | | institution in any
county, township, city, village or |
9 | | incorporated town to which prisoners
have been committed for |
10 | | imprisonment for conviction of misdemeanors or
for nonpayment |
11 | | of fines for violation of state law, ordinance,
resolution, |
12 | | rule or regulation of a township, city, village or
incorporated |
13 | | town may recommit such prisoners to confinement in any
other |
14 | | penal institution in the county in which, by contract or
|
15 | | otherwise, such prisoners may be held, but only with the |
16 | | consent of the
warden or superintendent of the other penal |
17 | | institution. In making such
recommitment the warden or |
18 | | superintendent shall take into consideration
the nature of the |
19 | | offense, the character of the offender, whether the
offender |
20 | | should be held under maximum security conditions and any other
|
21 | | condition pertinent to such decision. The warden or |
22 | | superintendent may
recommit prisoners committed to his |
23 | | institution to be confined in
another penal institution in |
