1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Criminal Code of 2012 is amended by changing
5Section 12-5.02 as follows:
 
6    (720 ILCS 5/12-5.02)   (was 720 ILCS 5/12-2.5)
7    Sec. 12-5.02. Vehicular endangerment.
8    (a) A person commits vehicular endangerment when he or she
9strikes a motor vehicle by causing an object to fall from an
10overpass or other elevated location in the direction of a
11moving motor vehicle with the intent to strike a motor vehicle
12while it is traveling upon a highway in this State.
13    (b) Sentence. Vehicular endangerment is a Class 2 felony,
14unless death results, in which case vehicular endangerment is a
15Class 1 felony.
16    (c) Definitions. For purposes of this Section:
17    "Elevated location" means a bridge, overpass, highway
18ramp, building, artificial structure, hill, mound, or natural
19elevation above or adjacent to and above a highway.
20    "Object" means any object or substance that by its size,
21weight, or consistency is likely to cause great bodily harm to
22any occupant of a motor vehicle.
23    "Overpass" means any structure that passes over a highway.

1    "Motor vehicle" and "highway" have the meanings as defined
2in the Illinois Vehicle Code.
