2 | AMENDMENT NO. ______. Amend House Bill 6030 by replacing | ||||||
3 | everything after the enacting clause with the following:

4 | "Section 5. The Illinois Pension Code is amended by adding | ||||||
5 | Section 1-140 as follows: | ||||||
6 | (40 ILCS 5/1-140 new) | ||||||
7 | Sec. 1-140. Identification of deceased annuitants. Every | ||||||
8 | pension fund or retirement system under this Code, except for a | ||||||
9 | pension fund established under Article 3 or 4 of this Code, | ||||||
10 | shall develop and implement, by no later than June 30, 2017, a | ||||||
11 | process to identify annuitants who are deceased. The process | ||||||
12 | shall require the pension fund or retirement system to check | ||||||
13 | for any deceased annuitants at least once per month and shall | ||||||
14 | include the use of any commonly used methods to identify | ||||||
15 | persons who are deceased, which include, but are not limited | ||||||
16 | to, the use of a third party entity that specializes in the |

1 | identification of deceased persons, the use of data provided by | ||||||
2 | the Social Security Administration, the use of data provided by | ||||||
3 | the Department of Public Health's Office of Vital Records, or | ||||||
4 | the use of any other method that is commonly used by other | ||||||
5 | states to identify deceased persons. | ||||||
6 | Section 10. The Vital Records Act is amended by adding | ||||||
7 | Section 24.5 as follows: | ||||||
8 | (410 ILCS 535/24.5 new) | ||||||
9 | Sec. 24.5. Access to records; pension funds and retirement | ||||||
10 | systems. Any information contained in the vital records shall | ||||||
11 | be made available at no cost to any pension fund or retirement | ||||||
12 | system under the Illinois Pension Code pursuant to Section | ||||||
13 | 1-140 of the Illinois Pension Code. | ||||||
14 | Section 90. The State Mandates Act is amended by adding | ||||||
15 | Section 8.40 as follows: | ||||||
16 | (30 ILCS 805/8.40 new) | ||||||
17 | Sec. 8.40. Exempt mandate. Notwithstanding Sections 6 and 8 | ||||||
18 | of this Act, no reimbursement by the State is required for the | ||||||
19 | implementation of any mandate created by this amendatory Act of | ||||||
20 | the 99th General Assembly.

21 | Section 99. Effective date. This Act takes effect upon |
