| 1 | AMENDMENT TO HOUSE BILL 6226

| 2 | AMENDMENT NO. ______. Amend House Bill 6226 by replacing | ||||||
| 3 | everything after the enacting clause with the following:

| 4 | "Section 5. The Illinois Highway Code is amended by adding | ||||||
| 5 | Section 4-106 as follows: | ||||||
| 6 | (605 ILCS 5/4-106 new) | ||||||
| 7 | Sec. 4-106. Misrepresentation. | ||||||
| 8 | (a) In relation to the submission of plans, maps, | ||||||
| 9 | specifications, costs of construction, bids, or contracts for | ||||||
| 10 | any Department project, it is unlawful for the Department, its | ||||||
| 11 | employees and its agents to knowingly falsify, distort, or | ||||||
| 12 | misrepresent any facts concerning, but not limited to, the | ||||||
| 13 | following: | ||||||
| 14 | (1) the character, quality, cost, or quantity of | ||||||
| 15 | material already used or to be used; | ||||||
| 16 | (2) the quality or quantity of any work already | ||||||
| |||||||
| |||||||
| 1 | performed or to be performed; and | ||||||
| 2 | (3) any other related costs. | ||||||
| 3 | (b) A violation of subsection (a) of this Section shall be | ||||||
| 4 | punishable by a fine of not more than $10,000 or by | ||||||
| 5 | imprisonment of not more than 5 years, or both. ".
