| 1 | AMENDMENT TO HOUSE BILL 6226

| 2 | AMENDMENT NO. ______. Amend House Bill 6226 by replacing | ||||||
| 3 | everything after the enacting clause with the following:

| 4 | "Section 5. The Illinois Highway Code is amended by adding | ||||||
| 5 | Section 9-132 as follows: | ||||||
| 6 | (605 ILCS 5/9-132 new) | ||||||
| 7 | Sec. 9-132. Highway design. A unit of local government may | ||||||
| 8 | consult a highway design publication outside the Department's | ||||||
| 9 | Bureau of Local Roads and Streets Manual for the construction | ||||||
| 10 | of any highway in ownership or control of the unit of local | ||||||
| 11 | government, except for a highway that is part of the National | ||||||
| 12 | System of Interstate and Defense Highways, if: | ||||||
| 13 | (1) the unit of local government receives federal or State | ||||||
| 14 | funds for the construction project; | ||||||
| 15 | (2) the highway design publication is approved by the | ||||||
| 16 | Federal Highway Administration; | ||||||

| 1 | (3) the highway design publication is adopted by the unit | ||||||
| 2 | of local government; and | ||||||
| 3 | (4) the design complies with all other applicable federal | ||||||
| 4 | laws.".
