|
2 | | AMENDMENT NO. ______. Amend Senate Bill 378 by replacing |
3 | | everything after the enacting clause with the following:
|
4 | | "Section 5. The Cook County Forest Preserve District Act is |
5 | | amended by changing Sections 14 and 20 as follows:
|
6 | | (70 ILCS 810/14) (from Ch. 96 1/2, par. 6417)
|
7 | | Sec. 14. The board, as corporate authority of a forest
|
8 | | preserve district, shall have power to pass and enforce all |
9 | | necessary
ordinances, rules and regulations for the management |
10 | | of the property and
conduct of the business of such district. |
11 | | The president of such board
shall have power to appoint a |
12 | | secretary and an assistant secretary, and
treasurer and an |
13 | | assistant treasurer and such other officers and such
employees |
14 | | as may be necessary, all of whom, excepting the treasurer and
|
15 | | attorneys, shall be under civil service rules and regulations, |
16 | | as
provided in Section 17 of this Act. The assistant secretary |

1 | | and assistant
treasurer shall perform the duties of the |
2 | | secretary and treasurer,
respectively, in case of death of said |
3 | | officers or when said officers
are unable to perform the duties |
4 | | of their respective offices because of
absence or inability to |
5 | | act. All contracts for supplies, material or
work involving an |
6 | | expenditure by forest preserve
districts in excess of $25,000 |
7 | | shall be let to the lowest
responsible bidder,
after due |
8 | | advertisement, excepting work requiring personal confidence or |
9 | | necessary
supplies under the control of monopolies, where |
10 | | competitive bidding is
impossible. Contracts for supplies, |
11 | | material or work involving an
expenditure of $25,000 or less |
12 | | may be let without advertising for bids,
but whenever |
13 | | practicable, at least 3 competitive bids shall be obtained
|
14 | | before letting such contract. Notwithstanding the provisions |
15 | | of this Section, a forest preserve district may establish |
16 | | procedures to comply with State and federal regulations |
17 | | concerning affirmative action and the use of small businesses |
18 | | or businesses owned by minorities or women in construction and |
19 | | procurement contracts. All contracts for supplies, material or
|
20 | | work shall be signed by the president of the board or and
by |
21 | | any such other officer as the board in its discretion may |
22 | | designate.
|
23 | | Salaries of employees shall be fixed by ordinance.

1 | | Sec. 20.
The president shall preside at all meetings of the |
2 | | board and
be the executive officer of the district. He shall |
3 | | sign all ordinances,
resolutions and other papers necessary to |
4 | | be signed and he or his designee shall execute
all contracts |
5 | | entered into by the district and perform other duties as
may be |
6 | | prescribed by ordinance. He may veto any ordinance and any
|
7 | | orders, resolutions and actions, or any items therein |
8 | | contained, of the
board which provide for the purchase of real |
9 | | estate, or for the
construction of improvements within the |
10 | | preserves of the district. Such
veto shall be filed with the |
11 | | secretary of the board within 5 days after
the passage of the |
12 | | ordinance, order, resolution or action and when so
vetoed the |
13 | | ordinance, order, resolution or action or any item therein
|
14 | | contained is not effective unless it is again passed by |
15 | | two-thirds vote
of all the members of the board. The president |
16 | | may vote in the same
manner as the other members of the board. |
17 | | In the temporary absence or
inability of the president, the |
18 | | members of the board may elect from
their own number a |
19 | | president, pro tem.

20 | | The "Yeas" and "Nays" shall be taken, and entered on the |
21 | | journal of
the board's proceedings, upon the passage of all |
22 | | ordinances and all
proposals to create any liability, or for |
23 | | the expenditure or
appropriation of money. The concurrence of a |
24 | | majority of all the members
appointed to the board is necessary |
25 | | to the passage of any such ordinance
or proposal. In all other |
26 | | cases the "Yeas" and "Nays" shall be taken at
the request of |
