SYNOPSIS AS INTRODUCED:
 
110 ILCS 205/9.34 new

    Amends the Board of Higher Education Act. Provides that the Board of Higher Education shall require all public and private institutions of higher education located in this State to submit an annual report on or before April 15, 2016 and on or before each April 15 thereafter, in a searchable Adobe PDF format, on all procurement goals and actual spending for female-owned, minority-owned, veteran-owned, and small business enterprises in the previous calendar year. Provides that each institution shall include certain information in its annual report. Provides that the Board and all institutions shall hold an annual workshop open to the public in July of 2016 and each July thereafter on the state of supplier diversity to collaboratively seek solutions to structural impediments to achieving stated goals. Sets forth other Board requirements. Effective immediately.

1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Board of Higher Education Act is amended by
5adding Section 9.34 as follows:
 
6    (110 ILCS 205/9.34 new)
7    Sec. 9.34. Supplier diversity goals.
8    (a) The public policy of this State is to collaboratively
9work with colleges and universities located in this State to
10improve their supplier diversity in a non-antagonistic manner.
11    (b) The Board shall require all public and private
12institutions of higher education located in this State,
13including community colleges, colleges, and universities, to
14submit an annual report on or before April 15, 2016 and on or
15before each April 15 thereafter, in a searchable Adobe PDF
16format, on all procurement goals and actual spending for
17female-owned, minority-owned (with breakdowns of African
18American-owned and Latino-owned), veteran-owned, and small
19business enterprises in the previous calendar year. These goals
20must be expressed as a percentage of the total work performed
21by the institution of higher education submitting the report,
22and the actual spending for all female-owned, minority-owned
23(with breakdowns of African American-owned and Latino-owned),

1veteran-owned, and small business enterprises must also be
2expressed as a percentage of the total work performed by the
3institution of higher education submitting the report.
4    (c) Each institution of higher education, in its annual
5report, shall include the following information:
6        (1) an explanation of the plan for the next year to
7    increase participation;
8        (2) an explanation of the plan to increase the goals;
9        (3) the areas of procurement the institution of higher
10    education shall be actively seeking more participation in
11    during the next year;
12        (4) an outline of the plan to alert and encourage
13    potential vendors in that area to seek business from the
14    institution of higher education;
15        (5) an explanation of the challenges faced in finding
16    quality vendors and any suggestions for what the Board
17    could do to be helpful in identifying those vendors;
18        (6) a list of the certifications proving status as a
19    female-owned, minority-owned, veteran-owned, or small
20    business enterprise the institution of higher education
21    recognizes;
22        (7) the point of contact for any potential vendor who
23    wishes to do business with the institution of higher
24    education and an explanation of the process for a vendor to
25    enroll with the institution of higher education as a
26    female-owned, minority-owned, veteran-owned, or small

1    business enterprise; and
2        (8) any particular success stories to encourage other
3    institutions of higher education to emulate best
4    practices.
5    (d) Each annual report shall include the rules,
6regulations, and definitions used for the procurement goals in
7the annual report.
8    (e) The Board and all institutions of higher education
9required to submit an annual report under this Section shall
10hold an annual workshop open to the public in July of 2016 and
11each July thereafter on the state of supplier diversity to
12collaboratively seek solutions to structural impediments to
13achieving stated goals, including testimony from each
14institution of higher education, as well as subject matter
15experts and advocates. The Board shall publish a database on
16its Internet website of the points of contact for supplier
17diversity listed in the annual report by each institution of
18higher education, along with a list of certifications proving
19status as a female-owned, minority-owned, veteran-owned, or
20small business enterprise that each institution of higher
21education recognizes from the information submitted in the
22annual report. The Board shall publish each annual report on
23its Internet website and shall maintain each annual report for
24at least 5 years.
 
25    Section 99. Effective date. This Act takes effect upon
26becoming law.
