AMENDMENT TO SENATE BILL 688

2    AMENDMENT NO. ______. Amend Senate Bill 688 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Department of Central Management Services
5Law of the Civil Administrative Code of Illinois is amended by
6adding Section 405-530 as follows:
 
7    (20 ILCS 405/405-530 new)
8    Sec. 405-530. Higher education supplier diversity report.
9    (a) Every institution of higher education approved by the
10Illinois Student Assistance Commission for purposes of the
11Monetary Award Program, whether public or private, shall submit
12a 2-page report on its voluntary supplier diversity program to
13the Department. The report shall set forth all of the
14following:
15        (1) The name, address, phone number, and e-mail address
16    of the point of contact for the supplier diversity program

1    (or the institution's procurement program if there is no
2    supplier diversity program) for vendors to register with
3    the program.
4        (2) Local and State certifications the institution
5    accepts or recognizes for minority-owned, women-owned, or
6    veteran-owned business status.
7        (3) On the second page, a narrative explaining the
8    results of the report and the tactics to be employed to
9    achieve the goals.
10        (4) With respect to public universities, the voluntary
11    goals, if any, for fiscal year 2016 in each category for
12    the entire budget of the institution (expending both public
13    and private moneys, including any fee-supported entities)
14    and the commodity codes or a description of particular
15    goods and services for the area of procurement in which the
16    institution expects most of those goals to focus on in the
17    next year. With respect to public universities, beginning
18    with the 2017 report, the actual spending for the entire
19    budget of the institution (expending both public and
20    private moneys, including any fee-supported entities) for
21    minority business enterprises, women's business
22    enterprises, and veteran-owned businesses, expressed both
23    in actual dollars and as a percentage of the total budget
24    of the institution. The report shall include the total
25    dollar amount subject to the Business Enterprise Program
26    under the Business Enterprise for Minorities, Females, and

1    Persons with Disabilities Act, the goal established by the
2    Business Enterprise Program, and the actual amount spent on
3    minority-owned, women-owned, and veteran-owned businesses
4    of dollars subject to the Business Enterprise Program goal.
5    The narrative report shall include the university's
6    Compliance Plan as defined by the Business Enterprise
7    Program.
8        (5) With respect to public community colleges, the
9    voluntary goals, if any, for fiscal year 2017 in each
10    category for the entire budget of the institution
11    (expending both public and private moneys, including any
12    fee-supported entities) and the commodity codes or a
13    description of particular goods and services for the area
14    of procurement in which the institution expects most of
15    those goals to focus on in the next year. However, a public
16    community college may report the information under this
17    subdivision (3) for fiscal year 2016 instead. With respect
18    to public community colleges, beginning with the 2018
19    report, the actual spending for the entire budget of the
20    institution (expending both public and private moneys,
21    including any fee-supported entities) for minority
22    business enterprises, women's business enterprises, and
23    veteran-owned businesses, expressed both in actual dollars
24    and as a percentage of the total budget of the institution.
25    However, if a public community college elects to report the
26    information under subdivision (3) of this subsection (a)

1    for fiscal year 2016 instead, then the information under
2    this subdivision (4) must be reported beginning with the
3    2017 report.
4        (6) With respect to private institutions of higher
5    education, the voluntary goals, if any, for either fiscal
6    year or calendar year 2017 in each category for the entire
7    budget of the institution (expending both public and
8    private moneys, including any fee-supported entities) and
9    the commodity codes or a description of particular goods
10    and services for the area of procurement in which the
11    institution expects most of those goals to focus on in the
12    next year. However, a private institution of higher
13    education may report the information under this
14    subdivision (3) for fiscal year or calendar year 2016
15    instead. With respect to private institutions of higher
16    education, beginning with the 2018 report, the actual
17    spending for the entire budget of the institution
18    (expending both public and private moneys, including any
19    fee-supported entities) for minority business enterprises,
20    women's business enterprises, and veteran-owned
21    businesses, expressed both in actual dollars and as a
22    percentage of the total budget of the institution. However,
23    if a private institution of higher education elects to
24    report the information under subdivision (3) of this
25    subsection (a) for fiscal year or calendar year 2016
26    instead, then the information under this subdivision (4)

1    must be reported beginning with the 2017 report.
2    Each public university is required to submit a searchable
3Adobe PDF report to the Department on or before November 15,
42016 and on or before November 15 every year thereafter. Each
5private institution of higher education is required to submit a
6searchable Adobe PDF report to the Department on or before
7November 15, 2017 and on or before November 15 every year
8thereafter. Each public community college is required to submit
9a searchable Adobe PDF report to the Illinois Community College
10Board on or before November 15, 2017 and on or before November
1115 every year thereafter. However, if a private institution of
12higher education or public community college elects to report
13the information under subdivision (3) of this subsection (a)
14for fiscal year or calendar year 2016 instead, then the
15institution is required to submit the report on or before
16November 15, 2016 and on or before November 15 every year
17thereafter. The Illinois Community College Board shall
18immediately forward to the Department all reports submitted to
19the Illinois Community College Board. The Illinois Community
20College Board is not responsible for collecting the reports or
21for the content of the reports.
22    (b) For each report submitted under subsection (a) of this
23Section, the Department shall publish the results on its
24Internet website for 5 years after submission or, with respect
25to public community colleges, for 5 years after the report has
26been forwarded to the Department by the Illinois Community

1College Board. The Department is not responsible for collecting
2the reports or for the content of the reports.
3    (c) The Department shall hold an annual higher education
4supplier diversity workshop in February of 2016 and every
5February thereafter to discuss the reports with
6representatives of the institutions of higher education and
7vendors.
8    (d) The Department shall prepare a one-page template (not
9including the narrative section) for the voluntary supplier
10diversity reports. For purposes of complying with the Business
11Enterprise for Minorities, Females, and Persons with
12Disabilities Act and notwithstanding any law to the contrary,
13the submission of these reports by public universities
14satisfies all reporting requirements.
 
15    Section 99. Effective date. This Act takes effect upon
16becoming law.".
