Amends the Illinois Vehicle Code. Allows all drivers, including motorcycle drivers, to at all times modulate the vehicle's head lamp between high and low brightness to signal oncoming drivers of the presence of a hazard, police officer, or radar speed detection area.

2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Illinois Vehicle Code is amended by changing |
5 | | Section 12-201 as follows:
|
6 | | (625 ILCS 5/12-201) (from Ch. 95 1/2, par. 12-201)

7 | | Sec. 12-201. When lighted lamps are required.
|
8 | | (a) When operated upon any highway in this State, every |
9 | | motorcycle shall at
all times exhibit at least one lighted |
10 | | lamp, showing a white light visible
for at least 500 feet in |
11 | | the
direction the motorcycle is proceeding. However, in lieu of |
12 | | such lighted
lamp, a motorcycle may be equipped with and use a |
13 | | means of modulating the
upper beam of the head lamp between |
14 | | high and a lower brightness. No such
head lamp shall be |
15 | | modulated, except as provided in subsection (a-5) of this |
16 | | Section or to otherwise comply with this Code,
during times |
17 | | when lighted lamps are required for other motor vehicles.

18 | | (a-5) On all motor vehicles, including motorcycles, which |
19 | | may be equipped with and use a means of modulating the upper |
20 | | beam of the head lamp between high and a lower brightness, |
21 | | drivers may at all times modulate the vehicle's head lamp to |
22 | | signal oncoming drivers of the presence of a hazard, police |
23 | | officer, or radar speed detection area. |

1 | | (b) All other motor vehicles , except motorcycles, shall
|
2 | | exhibit at least 2 lighted head lamps, with at least one on |
3 | | each side
of the front of the vehicle, which satisfy United |
4 | | States Department of
Transportation requirements, showing |
5 | | white lights, including that emitted
by high intensity |
6 | | discharge (HID) lamps, or lights of a yellow or amber tint,
|
7 | | during the period from sunset to sunrise, at times when rain, |
8 | | snow, fog, or
other atmospheric conditions require the use of |
9 | | windshield wipers, and at
any other times when, due to |
10 | | insufficient light or unfavorable atmospheric
conditions, |
11 | | persons and vehicles on the highway are not clearly discernible |
12 | | at
a distance of 1000 feet. Parking lamps may be used in |
13 | | addition to but not in
lieu of such head lamps. Every motor |
14 | | vehicle, trailer, or semi-trailer shall
also exhibit at least 2 |
15 | | lighted lamps, commonly known as tail lamps, which
shall be |
16 | | mounted on the left rear and right rear of the vehicle so as to |
17 | | throw
a red light visible for at least 500 feet in the reverse |
18 | | direction, except that
a truck tractor or road tractor |
19 | | manufactured before January 1, 1968 and all
motorcycles need be |
20 | | equipped with only one such tail lamp.

21 | | (c) Either a tail lamp or a separate lamp shall be so |
22 | | constructed
and placed as to illuminate with a white light a |
23 | | rear registration plate
when required and render it clearly |
24 | | legible from a distance of 50 feet
to the rear. Any tail lamp |
25 | | or tail lamps, together with any separate
lamp or lamps for |
26 | | illuminating a rear registration plate, shall be so
wired as to |

1 | | be lighted whenever the head lamps or auxiliary driving lamps
|
2 | | are lighted.
|
3 | | (d) A person shall install only head lamps that satisfy |
4 | | United States
Department of Transportation regulations and |
5 | | show white light, including that
emitted by HID lamps, or light |
6 | | of a yellow or amber tint for use by a motor
vehicle.
