| 2 | | AMENDMENT NO. ______. Amend Senate Bill 1376 on page 12, |
| 3 | | line 4, by changing "faith" to "faith, except for willful and |
| 4 | | wanton misconduct,"; and

| 5 | | on page 12 by inserting immediately below line 17 the |
| 6 | | following:

| 7 | | "Section 12.1. Conflict with federal law. Nothing |
| 8 | | contained in this Act is intended to supersede applicable |
| 9 | | federal law including, but not limited to, the Electronic |
| 10 | | Communications Privacy Act. In the event any provision of this |
| 11 | | Act is inconsistent with applicable federal law, the federal |
| 12 | | law shall prevail, but only to the extent of such |
| 13 | | inconsistency.".
