1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Counties Code is amended by changing the
5heading of Article Div. 5-5 and by adding Section 5-5002 as
6follows:

Division 5-5. Contracts for Police Protection

and Fire Protection

 
10    (55 ILCS 5/5-5002 new)
11    Sec. 5-5002. Identification of nongovernmental contracted
12fire protection services.
13    (a) For purposes of this Section:
14    "Conspicuously display" means to display a disclosure that
15is at least the same size as and located close to the largest
16logo referring to the county.
17    "Logo" means a symbol, graphic, seal, emblem, insignia,
18trade name, brand name, picture, or text identifying a person,
19firm, corporation, association, or county.
20    "Occurrence" means each vehicle or uniform in violation of
21this Section that could be viewed by members of the public that
22fails to display the required disclosure consistent with the

1provisions of this Section.
2    (b) Any nongovernmental entities that the county board
3contracts with to furnish fire protection services that display
4a logo of the county on the entity's vehicle or uniform shall
5also conspicuously display on all vehicles and uniforms the
6following disclosure:
7        (1) A statement indicating that the entity is the
8    service provider, contractor, or other appropriate
9    descriptor, with substantially similar language of
10    "SERVICE PROVIDED BY:" or "CONTRACTED BY:";
11        (2) The name of the contracting person, firm,
12    corporation, or association that is providing the labor or
13    services for the county;
14        (3) The state or federal tax designation of the
15    contracting person, firm, corporation, or association; and
16        (4) The entity's principal place of business as
17    disclosed in the entity's records with the Secretary of
18    State or other similar agency outside of Illinois.
19If a vehicle or uniform displays more than one logo referring
20to the county, then the required disclosure shall be placed
21near the largest logo referring to the county.
22    (c) A person or entity that violates this Section is guilty
23of a business offense and shall be fined $1,000 per occurrence.
24The circuit court in the county where a violation occurs shall
25have jurisdiction to enforce the provisions of this Section.
26    (d) A home rule unit may not regulate in a manner

1inconsistent with this Section. This Section is a limitation
2under subsection (i) of Section 6 of Article VII of the
3Illinois Constitution on the concurrent exercise by home rule
4units of powers and functions exercised by the State.
 
5    Section 10. The Township Code is amended by adding Section
6200-20 as follows:
 
7    (60 ILCS 1/200-20 new)
8    Sec. 200-20. Identification of nongovernmental contracted
9fire protection services.
10    (a) For purposes of this Section:
11    "Conspicuously display" means to display a disclosure that
12is at least the same size as and located close to the largest
13logo referring to the township.
14    "Logo" means a symbol, graphic, seal, emblem, insignia,
15trade name, brand name, picture, or text identifying a person,
16firm, corporation, association, or township.
17    "Occurrence" means each vehicle or uniform in violation of
18this Section that could be viewed by members of the public that
19fails to display the required disclosure consistent with the
20provisions of this Section.
21    (b) Any nongovernmental entities that the governing body of
22a township contracts with to furnish fire protection services
23that display a logo of a township on the entity's vehicle or
24uniform shall also conspicuously display on all vehicles and

1uniforms the following disclosure:
2        (1) A statement indicating that the entity is the
3    service provider, contractor, or other appropriate
4    descriptor, with substantially similar language of
5    "SERVICE PROVIDED BY:" or "CONTRACTED BY:";
6        (2) The name of the contracting person, firm,
7    corporation, or association that is providing the labor or
8    services for the township;
9        (3) The state or federal tax designation of the
10    contracting person, firm, corporation, or association; and
11        (4) The entity's principal place of business as
12    disclosed in the entity's records with the Secretary of
13    State or other similar agency outside of Illinois.
14If a vehicle or uniform displays more than one logo referring
15to the township, then the required disclosure shall be placed
16near the largest logo referring to the township.
17    (c) A person or entity that violates this Section is guilty

1    Section 15. The Illinois Municipal Code is amended by
2adding Section 11-6-8 as follows:
 
3    (65 ILCS 5/11-6-8 new)
4    Sec. 11-6-8. Identification of nongovernmental contracted
5fire protection services.
6    (a) For purposes of this Section:
7    "Conspicuously display" means to display a disclosure that
8is at least the same size as and located close to the largest
9logo referring to the municipality.
10    "Logo" means a symbol, graphic, seal, emblem, insignia,
11trade name, brand name, picture, or text identifying a person,
12firm, corporation, association, or municipality.
13    "Occurrence" means each vehicle or uniform in violation of
14this Section that could be viewed by members of the public that
15fails to display the required disclosure consistent with the
16provisions of this Section.
17    (b) Any nongovernmental entities that the corporate
18authorities of any municipality contracts with to furnish fire
19protection services that display a logo of a municipality on
20the entity's vehicle or uniform shall also conspicuously
21display on all vehicles and uniforms the following disclosure:
22        (1) A statement indicating that the entity is the
23    service provider, contractor, or other appropriate
24    descriptor, with substantially similar language of
25    "SERVICE PROVIDED BY:" or "CONTRACTED BY:";

2    (a) For purposes of this Section:

13    (b) Any nongovernmental entities that the Board of Trustees
14contracts with to furnish fire protection services pursuant to
15Section 11a that display a logo of a district on the entity's
16vehicle or uniform shall also conspicuously display on all
17vehicles and uniforms the following disclosure:
18        (1) A statement indicating that the entity is the
19    service provider, contractor, or other appropriate
20    descriptor, with substantially similar language of
21    "SERVICE PROVIDED BY:" or "CONTRACTED BY:";
22        (2) The name of the contracting person, firm,
23    corporation, or association that is providing the labor or
24    services for the district;
25        (3) The state or federal tax designation of the
26    contracting person, firm, corporation, or association; and

1        (4) The entity's principal place of business as
2    disclosed in the entity's records with the Secretary of
