AMENDMENT TO SENATE BILL 3336

2    AMENDMENT NO. ______. Amend Senate Bill 3336 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Pharmacy Practice Act is amended by adding
5Section 30.1 as follows:
 
6    (225 ILCS 85/30.1 new)
7    Sec. 30.1. Reporting of termination for cause.
8    (a) A pharmacist in charge shall report to the Department
9within 60 days when a pharmacist, registered certified pharmacy
10technician, or registered pharmacy technician is terminated
11from employment for cause, as defined by rule. If a pharmacist
12in charge is terminated by a pharmacy for cause, it shall be
13the responsibility of the pharmacy to report that termination
14to the Department within 60 days.
15    (b) The report of a termination for cause shall include
16documentation of the reason for the termination, including any

1underlying pharmacy records used to reach the decision to
2terminate, as described by rule.
3    (c) Any individual or organization acting in good faith,
4and not in a willful and wanton manner, in complying with this
5Section by providing any report or other information to the
6Department or by participating in proceedings of the Department
7shall not, as a result of such actions, be subject to criminal
8prosecution or civil damages.
9    (d) Any information reported or disclosed shall be kept for
10the confidential use of the Department and shall not be
11disclosed to anyone other than as provided in Section 2105-117
12of the Department of Professional Regulation Law of the Civil
13Administrative Code of Illinois.
 
14    Section 99. Effective date. This Act takes effect upon
15becoming law.".
