Synopsis As Introduced
Amends the School Code. Provides that any information of a personal nature disclosed by a pupil 12 years of age or older in the process of receiving school counseling services from a school counselor or school counselor intern is confidential, and provides that any information of a personal nature disclosed to a school counselor or school counselor intern by a parent or guardian of such a pupil is confidential. Provides that the information must not become part of the pupil's record without the written consent of the pupil who disclosed the confidential information. Provides that the information must not be revealed, released, discussed, or referred to, with exceptions. Provides that except in cases of willful or wanton misconduct, no person required to keep the information confidential may incur any civil or criminal liability as a result of keeping that information confidential. Amends the State Mandates Act to require implementation without reimbursement.

Deletes everything after the enacting clause. Amends the Illinois School Student Records Act. Provides that nothing in the Act shall be construed to impair or limit the confidentiality of information communicated in confidence to a school social worker, school counselor, school psychologist, or intern working under the direct supervision of a school social worker, school counselor, or school psychologist. Provides that no employer shall take, attempt to take, or threaten to take adverse employment action or in any manner discriminate against an employee because the employee invokes his or her professional and legal responsibility to protect the confidentiality of communications protected by law or applicable standards of professional responsibility as privileged or confidential.

House Floor Amendment No. 2
Provides that nothing in the Act shall be construed to impair or limit the confidentiality of information communicated in confidence to a school social work, school counselor, or school psychologist intern (instead of just intern) working under the direct supervision of a school social worker, school counselor, or school psychologist. Provides that no school employee shall be subjected to adverse employment action, the threat of adverse employment action, or any manner of discrimination because the employee is acting or has acted to protect communications as privileged or confidential pursuant to applicable standards of professional responsibility, ethical codes, or relevant provisions of State or federal law. Adds an immediate effective date.
