Synopsis As Introduced Amends the Sex Offender Registration Act. Provides that the initial registration fee and the annual renewal fee shall be collected by the registering agency. Provides that $35 of the initial registration fee and $35 of the annual renewal fee shall be retained by the registering agency and the remaining $65 of the initial registration fee and the remaining $65 of the annual renewal fee shall be remitted by the registering agency within 30 days of receipt to the State Treasurer who shall deposit $5 of the initial registration fee and $5 of the annual renewal fee into the Sex Offender Management Board Fund, $30 of the initial registration fee and $30 of the annual renewal fee into the Sex Offender Registration Fund, and $30 of the initial registration fee and $30 of the annual renewal fee into the Attorney General Sex Offender Awareness, Training, and Education Fund.
House Committee Amendment No. 2 Replaces everything after the enacting clause. Amends the Sex Offender Registration Act. Provides that $35 of the initial $100 registration fee and $35 of the annual $100 renewal fee shall be retained and used by the registering agency for official purposes. Provides that having retained $35 of the initial registration fee and $35 of the annual renewal fee, the registering agency shall remit the remainder of the fee to State agencies within 30 days of receipt for deposit into specified State funds. Provides that the registering agency shall establish procedures to document the remittance of the $100 initial registration fee and $100 annual renewal fee.
Provides that the Act may be referred to as the Gun Safety and Responsibility Act. Replaces everything after the enacting clause. Amends the Firearm Owners Identification Card Act. Provides that a private party who sells or transfers a firearm must use the State Police's dial-up system to verify that the buyer or transferee is the holder of a valid Firearm Owners Identification ("FOID") card before making the transfer. Provides for exceptions; sets forth record keeping requirements. Requires the State Police to develop an Internet-based system for individuals to determine the validity of a FOID card prior to sale or transfer. Amends the Criminal Code of 2012. Provides that the sellers and transferors of firearms who determine the validity of a FOID card prior to sale or transfer are not civilly liable for any misuse of the firearm by the buyer or transferee. Provides that the owner of a lost or stolen firearm must report the loss or theft of the firearm to law enforcement within 72 hours of discovering the loss or theft. Effective immediately.
