Synopsis As Introduced
Amends the Environmental Protection Act. Provides that any facility (instead of a facility located in a county with a population of over 700,000) that is operated in accordance with a Section concerning the exclusive acceptance of general construction or demolition debris is not a "pollution control facility". Effective immediately.

Senate Floor Amendment No. 1
Deletes everything after the enacting clause. Amends the Environmental Protection Act. Excludes from the definition of "pollution control facility" the portion of a site or facility, located within a unit of local government that has enacted local zoning requirements, that: (i) accepts uncontaminated broken concrete with or without protruding metal bars for separation and processing; and (ii) provided these materials are not speculatively accumulated, returns these materials to the economic mainstream in the form of raw materials or products. Effective immediately.

House Committee Amendment No. 1
Provides that for a portion of a site or facility that is used to recycle concrete to be excluded from the definition of a "pollution control facility", the portion of the site or facility must be used to accept, separate, and process uncontaminated broken concrete (instead of accepting the uncontaminated broken concrete for separation and processing) and may not be used to contain the concrete or metal bars for longer than one year.
