Synopsis As Introduced
Amends the Public Utilities Act to establish standards for production of electricity through renewable energy resources. Requires electric utilities and alternative retail electric suppliers to supply to Illinois customers electricity produced from renewable energy resources on an increasing scale beginning at 2% in 2005 and rising to 15% in 2020 and each year thereafter. Provides for enforcement by the Illinois Commerce Commission. Effective immediately.

 Fiscal Note (Illinois Commerce Commission)
 The provisions of HB 2200 requiring the ICC to enforce compliance of utilities and alternative electric suppliers with the renewable resources portfolio standard, and to make that information publicly available, are expected to require the equivalent of two full-time employees, and the normally anticipated annual cost of those two employees is anticipated to be $122,000.

House Committee Amendment No. 1
Deletes all substantive provisions of the bill; leaves a Section caption only. Also makes a technical correction.

 Fiscal Note (S-AM1) (Environmental Protection Agency)
 The only impact to the Agency would involve the staff time necessary to assist DCEO in completing its required evaluation under the bill, a cost the Agency could absorb with its existing resources.

Replaces everything after the enacting clause. Amends the Public Utilities Act. Provides that the Illinois Commerce Commission shall, within 9 months after an application is filed, issue its Order approving or denying any proposed reorganization involving the acquisition by a public utility or its affiliate of all of the common stock or substantially all of the operating assets, whether by merger, creation, and acquisition of a limited liability or other company, or otherwise, of another public utility that has secured debt which is, or was, within the year prior to the filing of the application, rated below investment grade by at least three nationally recognized rating agencies. Provides that an electric utility that serves over one million customers within this State, and any electric utility that is affiliated with such an electric utility, shall use its best efforts to procure by the end of 2005 renewable energy resources equal to at least 2% of the electric energy to be sold by the electric utility to retail customers within its service area during the following calendar year, and procure by the end of 2006 renewable energy resources equal to at least 3% of the electric energy to be sold by the electric utility to retail customers within its service area during the following calendar year. Provides that the Commission, together with the Department of Commerce and Economic Opportunity, shall evaluate the availability and use of renewable energy resources within this State and shall also consider the feasibility of adoption of an enforceable mandatory renewable energy resource portfolio standard to be applicable to all electric utilities and all alternative retail electric suppliers. Provides that costs associated with the procurement of certain renewable energy resources shall be fully recoverable from retail customers to the extent allowed by law and shall not be subject to specified limitations relating to the recovery of the power and energy cost component in tariffed rates. Effective immediately.

Senate Floor Amendment No. 4

Replaces everything after the enacting clause. Amends the Public Utilities Act. Provides that the Illinois Commerce Commission shall, within 9 months after an application is filed, but in no event later than one year after the effective date of this amendatory Act, issue its Order approving or denying any proposed reorganization involving the acquisition by a public utility or its affiliate of all of the common stock or substantially all of the operating assets, whether by merger, creation, and acquisition of a limited liability or other company, or otherwise, of another public utility that has secured debt which is, or was, within the year prior to the filing of the application, rated below investment grade by at least three nationally recognized rating agencies. Grants the Commission the authority, consistent with State jurisdiction, to review and approve any purchased power agreement related to the reorganization agreement. Effective immediately.
