Synopsis As Introduced
Amends the Illinois Vehicle Code. Provides that a vehicle using diesel fuel with a Gross Vehicle Weight Rating of more than 8,000 pounds may not have its engine idling for more than 3 minutes within any 60 minute period. Creates exemptions. Provides that a violation is a petty offense punishable by a fine of $100 for a first offense and $500 for a second or subsequent offense within any 12 month period. Provides that the provision applies on highways and elsewhere throughout the State.

House Committee Amendment No. 1
Deletes everything after the enacting clause. Reinserts the provisions of the original bill, with changes, additions, and deletions. Provides that the provision applies only in specified counties and townships. Provides that these vehicles may not have their engines idling more than 10 (rather than 3) minutes in any 60 minute period. Provides that an exemption applies to vehicles used in production agriculture (rather than in farming operations). Provides that an exemption applies when the outdoor temperature is less than 32 (rather than 0) degrees Fahrenheit. Reduces the fines from $100 to $50 for a first offense and from $500 to $150 for a second or subsequent offense within any 12 month period. Deletes language providing that the provision applies on highways and elsewhere throughout the State.

 Fiscal Note (H-AM 1) (Illinois Environmental Protection Agency)
 House Bill 2347, as amended by House Amendment 1, would not have any fiscal impact on the Illinois Environmental Protection Agency, although the Illinois State Police and other police jurisdictions in charge of enforcing laws in the Illinois Vehicle Code could be impacted regarding the bill's enforcement.

House Floor Amendment No. 2
Provides that an exemption applies when operation of the vehicle is required for safety checks. Provides that an exemption always applies if the vehicle is a school bus (rather than only when the school bus is undergoing a pre-trip inspection).

Senate Floor Amendment No. 1
Provides that the prohibition applies to the operator (rather than to the owner or the operator) of a vehicle. Provides that only the operator (rather than either the owner or the operator) of a vehicle may be prosecuted for a violation of the provision. Provides that the provision does not apply to the owner of a motor vehicle rented or leased to another entity or person operating the vehicle.
