Synopsis As Introduced
Amends the Public Utilities Act. Provides that a gas utility offering unregulated sales of natural gas to an end-use customer within or outside its service area shall be subject to specified provisions of the Act with respect to such sales. Provides that a gas utility offering unregulated sales of natural gas to an end-use customer within or outside its service area shall not subsidize such sales through the utility's regulated business. Provides that a gas utility offering unregulated sales of natural gas to an end-use customer within or outside its service area shall not discriminate in the provision of regulated gas service based upon the existence or terms of an unregulated sale of natural gas. Provides that the Commission may require a gas utility to file reports regarding its unregulated sales of natural gas in the State and shall have access to, for the purpose of review, a gas utility's contracts for unregulated sales of natural gas. Effective immediately.

Senate Floor Amendment No. 1
Deletes everything after the enacting clause. Inserts provisions substantially similar to those of SB 2525 except: (1) provides that costs and revenues from the gas utility's unregulated sales of gas to an end-use customer within or outside its service area shall not be included in the calculation of the utility's regulated gas rates and charges; (2) provides that the Commission shall require a gas utility to file reports regarding it unregulated sales of natural gas in the State; (3) provides that the Commission shall adopt provisions requiring functional separation between a gas utility's unregulated retail sales of natural gas in the State and its regulated retail gas services in the State; (3) provides that a gas utility shall not release or assign gas storage capacity procured for its regulated Illinois retail customers to its business division offering unregulated retail sales of natural gas or allow such storage capacity to be managed by that business division; and (4) makes other changes.

 No fiscal effect on a single-family residence.

 Fiscal Note (Illinois Commerce Commission)
 Senate Bill 2525 does not include any funding for ICC oversight of these new unregulated gas utility sales and does not require the gas utility to pay the Illinois Public Utility Tax on those sales. To the extent that those sales replace regulated sales, the legislation will result in a decline of revenues collected under the Illinois Public Utility Tax. To police the actions of the gas utility under this new legislation would require 3 additional Agency staff, one accountant, one economist, and one engineer, at an estimated annual increase in costs of $250,870 to implement this legislation were it to become law. This estimate includes those salaries, fringe benefits, equipment, and commodities for 3 additional Agency staff members. These additional Agency staff members would spend their time examining gas utility operations, records, and transactions to ensure that the utility engaged in sales under proposed new 7-210 was not subsidizing unregulated sales with regulated businesses or using discriminatory practices in regulated businesses to aid unregulated sales. This work would be done primarily during the annual Uniform Purchased Gas Adjustment Clause reconciliation cases under existing Section 9-220.

 Would not impact any public pension fund or retirement system in Illinois.

 State Debt Impact Note (Economic and Fiscal Commission)
 Would not change the amount of authorization for any type of State-issued or State-supported bond, and therefore, would not affect the level of State indebtedness.

 Senate Bill 2525, as engrossed, does not pre-empt home rule authority.
