Synopsis As Introduced
Creates the Toxin-Free Toddler Act. Provides that, beginning January 1, 2013, no manufacturer or wholesaler may sell or offer for sale in this State a children's food or beverage container that contains bisphenol A (BPA). Provides that, beginning January 1, 2014, no retailer may sell or offer for sale in this State a children's food or beverage container that contains bisphenol A (BPA). Provides for enforcement by the Attorney General. Authorizes the imposition of a $200 civil penalty for violations of the Act. Defines "child", "children's food or beverage container", "manufacturer", "retailer", and "wholesaler". Effective immediately.

Senate Committee Amendment No. 1
Provides for the repeal of the Act if the United States Food and Drug Administration promulgates a final rule amending its food additive regulations to prohibit the use of polycarbonate resins in infant feeding bottles and spill-proof cups.

House Floor Amendment No. 1
Replaces everything after the enacting clause. Reinserts the provisions of the engrossed bill with changes. Provides that, beginning January 1, 2014, a retailer may not knowingly sell or offer for sale in this State a children's food or beverage container that contains bisphenol A. Effective immediately.
