Synopsis As Introduced
Amends the Carnival and Amusement Rides Safety Act. Provides that an owner or operator of an amusement ride or amusement attraction at a carnival or fair that violates the Act or a rule adopted under the Act is subject to a civil penalty not to exceed $2,500 per violation for a first violation and not to exceed $5,000 for a second or subsequent violation. Provides that each day the violation continues constitutes a separate violation. Provides that penalties may be recovered in a civil action brought by the Director of Labor and that the Director of Labor shall be represented by the Attorney General. Effective January 1, 2009.

House Committee Amendment No. 1
Provides that neither the Governor nor any agency or agency head under the jurisdiction of the Governor has any rulemaking authority under the amendatory Act, but that the Governor may suggest rules by filing them with the General Assembly and requesting that the General Assembly authorize such rulemaking by law, enact the suggested rules into law, or take other appropriate action in the General Assembly's discretion.

Replaces everything after the enacting clause. Amends the Carnival and Amusement Rides Safety Act. Makes various changes regarding: applying for a permit to operate an amusement ride or amusement attraction at a carnival or fair; penalties for violation of the Act; notices and fact-finding conferences; procedures relating to criminal history records checks and checks of the Illinois Sex Offender Registry; and exemption of carnival workers who are foreign nationals and have been granted visas by the United States Citizenship and Immigration Services in conjunction with the United States Department of Labor's H-2B or J-1 programs and are lawfully admitted into the United States from the background check requirement. Provides that neither the Governor nor any agency or agency head under the jurisdiction of the Governor has any rulemaking authority under the amendatory Act, but that the Governor may suggest rules by filing them with the General Assembly and requesting that the General Assembly authorize such rulemaking by law, enact the suggested rules into law, or take other appropriate action in the General Assembly's discretion. Makes other changes. Effective immediately.
