Amends the Illinois Horse Racing Act of 1975. Makes a technical change in a Section concerning the short title.

Replaces everything after the enacting clause. Amends the Department of Revenue Law of the Civil Administrative Code of Illinois and the Riverboat Gambling Act. Separates the Illinois Gaming Board from the Department of Revenue for the purposes of enforcing and administering the Riverboat Gambling Act. Makes conforming changes. Allows members of the Illinois Gaming Board to hold other public office for which they shall receive compensation of up to $10,000, other than necessary travel or other incidental expenses. Requires that a licensee involved in the ownership or management of gambling operations submit to the Board an annual balance sheet and profit and loss statement and a list of the stockholders or other persons having any beneficial interest (was, a 1% or greater beneficial interest) in the gambling activities of each licensee. Requires that the annual balance sheet and profit and loss statement and the list of stockholders or other persons having any beneficial interest in the gambling activities of each licensee shall be posted on the Board's Internet website and updated annually. In provisions concerning the disclosure records, changes provisions requiring disclosure of interests, including equity interests, of 5% or more to require disclosure of any interests and requires that certain information be posted on the Board's Internet website and updated annually. Prohibits Board members and Board employees from gambling at any gambling operation subject to the jurisdiction of the Board or any race track, race meeting, racing association, or the operations thereof subject to the jurisdiction of the Illinois Racing Board. Prohibits a Board member or Board employee or spouse, parent, or child of such person from being an official of or having a financial interest in any entity subject to the jurisdiction of the Board or any race track, race meeting, racing association, or the operations thereof subject to the jurisdiction of the Illinois Racing Board. Provides that no former Board member or Board employee or spouse, parent, or child of such person shall, within a period of 5 years immediately after termination of service, have a financial interest in or accept employment or receive compensation or fees for services from a person or entity subject to the jurisdiction of the Board or any race track, race meeting, racing association, or the operations thereof subject to the jurisdiction of the Illinois Racing Board. Provides that, in addition to the requirements under the State Officials and Employees Ethics Act, ex parte communications made to a Board member or Board employee must be publicly disclosed and made part of the Board's official record on the next business day following the day on which the communications occurred. Provides penalties for violations. Effective January 1, 2006.
