Synopsis As Introduced
Amends the Liquor Control Act of 1934 and the Freedom of Information Act. Requires all alcohol servers to obtain and complete training in basic responsible alcohol service. Provides that the Illinois Liquor Control Commission shall only approve training programs that meet certain specified criteria for content, method of instruction, and ability to provide information about whether a server has completed the training program. Provides that materials submitted to the Commission for training program approval shall be exempt from disclosure under the Freedom of Information Act. Requires the Commission to issue a State seal file and approval number to providers who are approved to conduct a responsible alcohol service training program. Provides that a certificate of training is valid for 3 years. Provides that before January 1, 2016, enforcement of the provisions shall be limited to education and notification of the requirements. Makes other changes. Effective immediately.

Replaces everything after the enacting clause. Amends the Liquor Control Act of 1934. Requires all alcohol servers, except for alcohol servers who have been issued a valid server certificate by a certified Beverage Alcohol Sellers and Servers Education and Training (BASSET) trainer between July 1, 2012 and July 1, 2015, to complete training in basic responsible alcohol service by July 1, 2015 or within 30 days after the alcohol server begins his or her employment, whichever is later. Provides that a responsible alcohol service training certificate shall be valid for 3 years. Provides that no later than April 1, 2015, BASSET trainers shall be recertified by the Liquor Control Commission and be required to comply with the conditions for server training set forth in the amendatory Act. Provides that training modules and certificate program plans must be approved by the Commission. Sets forth criteria for classroom-based training, online training, computer-based training, and testing. Requires a certificate program to provide access on a 24-hour-per-day, 7 days-per-week basis for certificate verification. Provides that a certificate issued from a BASSET-licensed training program shall be accepted as meeting the training requirements for all server license and permit laws and ordinances in this State. Provides that before January 1, 2016, enforcement of the provisions shall be limited to education and notification of the requirements. Makes other changes. Effective immediately.

House Floor Amendment No. 3
Provides that the server training requirement (i) only applies to servers in Cook County and (ii) does not apply to special event retailers. Provides that a server must complete the server training requirement within 120 days (instead of 30 days) after the server begins his or her employment. Provides that all existing Beverage Alcohol Sellers and Servers Education and Training (BASSET) trainers shall be recertified by the Liquor Control Commission and must comply with the conditions set forth in the amendatory Act by October 1, 2015 (instead of April 1, 2015). Changes the effective date from immediate to July 1, 2015.
