Synopsis As Introduced
Amends the Residential Tenants' Right to Repair Act. Makes a technical change in a Section concerning the short title.

Replaces everything after the enacting clause. Amends the Code of Civil Procedure. Provides that the court in a supplementary proceeding may enter any order upon or judgment against the respondent cited that could be entered in any garnishment proceeding and provides that the new provision shall be construed as being declarative of existing law and not as a new enactment. Provides that if a judgment becomes dormant during the pendency of certain enforcement proceedings, the enforcement may continue to conclusion without revival of the underlying judgment so long as the enforcement is done under court supervision and includes a payment, withholding, or turn over order. In a Section concerning liens of judgment, replaces cross-references to repealed Sections with cross references to the Uniform Foreign-Money Claims Act and the Uniform Foreign-Country Money Judgments Recognition Act. Provides that certain foreign judgments are a lien upon the real estate of the person against whom they are entered only from the time certain documentation is filed in the office of the recorder in the county in which the real estate is located. Provides that a garnishment summons may be served and returned in the manner provided by Supreme Court Rule for service, otherwise than by publication, of a notice for additional relief upon a party in default.

House Floor Amendment No. 1
Replaces amendatory provisions concerning revival of a judgment. Provides that if a judgment becomes dormant during the pendency of an enforcement proceeding against wages (instead of simply an enforcement proceeding) under certain provisions of the Code of Civil Procedure, the enforcement may continue to conclusion without revival of the underlying judgment so long as the enforcement is done under court supervision and includes a wage deduction order (instead of a payment or withholding) or turn over order, and adds that the enforcement must be against an employer, garnishee, or other third party respondent.
