Synopsis As Introduced
Amends the Illinois Highway Code. Provides that motor fuel tax funds allotted to municipalities may be used for the treatment or removal of trees infected with Dutch elm disease or ash trees infected with the emerald ash borer from any parcel of public or private property within the municipality.

Senate Committee Amendment No. 2
Removes the provision that money used for treatment on private property is eligible for reimbursement under the Illinois Municipal Code. Restricts the use of motor fuel tax funds in the treatment or removal of ash trees to the following situations: (1) the municipality is located in the emerald ash borer internal State quarantine zone most recently published by the Illinois Department of Agriculture, unless the Department has determined that the entire State has become infested and rescinded the quarantine zone; (2) the trees are located on the public right-of way or are a potential hazard to vehicle travel; (3) the trees to be removed are shown in a detailed inventory; and (4) motor fuel tax funds are not used to plant replacement trees.
