Replaces everything after the enacting clause. Amends the Illinois Enterprise Zone Act. Provides that an Enterprise Zone may be extended for an additional 10 years upon application by the corporate authorities of the county or municipality that designated the Enterprise Zone. Provides that the Department of Commerce and Economic Opportunity shall approve the application if, upon completion of the term set forth in the original certified designating ordinance, the area where the Enterprise Zone is located satisfies the requirements for certification as an Enterprise Zone. Amends the Public Utilities Act to make conforming changes in provisions concerning tax exemptions for businesses located in Enterprise Zones.
Makes changes to the bill as amended by Senate Amendment 1 to provide that an Enterprise Zone may be extended for an additional 20 years (instead of 10 years). Removes a requirement from the bill as amended by Senate Amendment 1 that the area must satisfy the requirements for certification as an Enterprise Zone at the time of the extension. Amends the Retailers' Occupation Tax Act. Provides that exemptions granted under the Act for tangible personal property used or consumed in an Enterprise Zone may be in effect for not more than 50 (instead of 20) years.
Replaces everything after the enacting clause. Creates the Public Private Agreements for the Illiana Expressway Act. Provides that the Illinois Department of Transportation on behalf of the State may, pursuant to a competitive request for proposals process governed by the Illinois Procurement Code and rules adopted under that Code and the new Act, enter into one or more public private agreements with one or more contractors to develop, finance, construct, manage, or operate the Illiana Expressway on behalf of the State, and further pursuant to which the contractors may receive certain revenues including user fees in consideration of the payment of moneys to the State for that right. Contains provisions concerning: procurement; prequalification; provisions of the agreement; interim agreements; termination; proceeds; the creation of the Illiana Expressway Proceeds Fund as a special fund in the State treasury; user fees; selection of design firms; other contracts; planning; reporting; publication; tolls; audits; property acquisition; standards; finance; labor; law enforcement; prohibited local action and preemption of home rule; and severability. Amends the Department of Transportation Law of the Civil Administrative Code of Illinois, Illinois Finance Authority Act, State Finance Act, Public Construction Bond Act, Employment of Illinois Workers on Public Works Act, Business Enterprise for Minorities, Females, and Persons with Disabilities Act, Retailers' Occupation Tax Act, Property Tax Code, and Prevailing Wage Act to implement the new Act. Makes other changes. Effective immediately.
House Floor Amendment No. 2 Replaces everything after the enacting clause and reinserts provisions similar to those of House Amendment No. 1, with various changes in relation to: changing "request for qualifications" to "request for proposals"; findings; provisions of the public private agreement; public private agreement proceeds; technical corrections; and other matters. Effective immediately.
