Synopsis As Introduced
Amends the Illinois Public Aid Code. Provides for Medicaid eligibility for persons who (i) are age 60 or older, (ii) have an ongoing need for medical services for the monitoring or treatment of a chronic condition, without which institutionalization would be necessary, and (iii) have income and resources that are equal to or less than the monthly maintenance allowance and resource allowance amounts for a community spouse as set forth in the Social Security Act. Effective immediately.

House Committee Amendment No. 1
Deletes the bill's amendatory provisions adding a class of persons eligible for Medicaid and reinserts substantially similar provisions, except provides for eligibility for persons 60 or older who have an ongoing need for medical services and who have income equal to or less than the maximum allowed under the spousal impoverishment provisions of federal law and have resources that are equal to or less than 20% of the maximum spousal resource limit allowed under those spousal impoverishment provisions (instead of who have income and resources that are equal to or less than the monthly maintenance allowance and resource allowance amounts for a community spouse as set forth in certain provisions of the Social Security Act).

Replaces everything after the enacting clause. Amends the Illinois Public Aid Code. Requires the Department of Healthcare and Family Services to operate a pilot project to determine the effect of raising the income and non-exempt asset eligibility thresholds for certain persons with disabilities on those persons' ability to maintain their homes in the community and avoid institutionalization. Limits enrollment to 50 persons per year. Sets forth criteria that persons must meet to enroll in the pilot project. Authorizes the Department to use emergency rulemaking to implement these provisions. Repeals these provisions on June 30, 2012. Effective immediately.

 For every 100 disabled persons aged 60 or older added to the AABD caseload, FY 08 cost is estimated at $1.2 million annually.

 For every 50 disabled persons aged 60 or older added to the AABD caseload, FY cost is estimated at $600,000 annually.
